This chapter deals with the systems of laws by which governments regulate the exploration for and production of the minerals within their jurisdictions. It is a summary, restricted by necessary space limitations, of material assembled by the author for a forthcoming publication of the United States Bureau of Mines, "Summary of Mining and Petroleum Laws of the World." (Information Circular, 1959.) The present study is organized in three parts, dealing with (1) the historical background of these legal systems, (2) laws of the United States, and (3) laws of other countries of the world. The reader's attention is invited to the acknowledgments at the end of the chapter, which inadequately express the appreciation due those who have assisted in the collection of this material. Part I. Historical Development of Major Western Systems of Land Tenancy with Respect to the Ownership and Control of Minerals The use of metals in primitive societies was largely confined to the manufacture of weapons for self-preservation. The ruler's control over copper, then brass, then iron, was essential to maintenance of his own ascendancy at home and his group's position against neighbors who had access to similar metals. Ancient societies were thus characterized by the ruling group's ownership of minerals and metals. The Egyptian civilization, which emerged in the fourth millenium B.C. upon the agricultural subjugation of the lower valley of the Nile, was responsible for extensive development of the upper valley as a source of mineral wealth. The production of gold during the height of that civilization has been estimated at $30,000,000 per year, thus equaling the early placers of California and Australia. The mines of Egypt were the property of the Pharaohs and were controlled at their direction. Greek mining developed a different scheme of land tenancy which more closely resembled modem concepts. Real gross national product increased at a larger-than- expected annual rate of 8.3 percent in the first quarter of 1984, with both consumption and investment spending increasing significantly in real terms (table 1). Residential and nonresidential fixed investment increased at annual rates of 25.7 and 14.6 percent during the first quarter of 1984, and investment in nonresidential structures, which declined in 1983, also increased during the first quarter of 1984, nearly attaining its 1982 level. The annual level of personal savings increased $27.7 billion, while the personal savings rate (the ratio of personal savings to disposable income) increased to 5.8 percent during the first quarter. The increase in the personal savings rate comes as welcome news to analysts concerned over the flow of loanable funds to the private sector and the impact on interest rates in 1984 of increased private and Government demands. U.S. Minerals Industry Performance A major upswing in the performance of the metal mining sector occurred during the first quarter of 1984, with production increasing almost 11.2 percent from January to March, The recovery of the metal sector is also reflected in the performance of primary metal industry profits, which were positive during fourth quarter 1983 following seven consecutive quarterly losses (table 1). Two thousand nine hundred more metal mining production workers were employed in February 1984 than in February 1983.

A PART of the Bureau of Mines effort to improve the conversion of coal to liquid fuels, batch autoclave tests were made on the hydrogenation of bituminous coal by a dry method, which featured charging the autoclave with dry ingredients only-coal, catalyst, and hydrogen. This innovation, which omitted the liquid vehicle used in earlier work, limited the products to those made from the coal charged. The effects of the common process variables (catalyst, hydrogen pressure, temperature, and residence time) were studied. Tin catalysts showed the highest activity in the widest variety of forms and were the easiest to disperse; dry mixing in the autoclave during the heating-up period usually sufficed. Ammonium molybdate, on the other hand, was inactive when dry mixed, but it compared favorably with the best catalysts known when applied by impregnating the coal with a solution of a molybdenum compound. As a group, metal naphthenates were the most effective; in fact, molybdenum naphthenate was the most active catalyst the Bureau tests disclosed. One-hundredth of a percent of molybdenum in this form (calculated as the metal in weight-percent of maf coal) induced 90-percent conversion of coal. However, because of their high cost, naphthenates have as yet only technical significance in coal hydrogenation. Long residence time and high reaction temperatures tend to increase the amount of thermal decomposition products formed (light hydrocarbon gases and/or char). High hydrogen pressure favors the production of liquids.

This Country Documentation Report presents the development of economic indices for Zambia for the period from 1970 through 1981. The work done through the Bureau of' Mines, Minerals Availability Program, under Contract number J0225001. This contract calls for the development of twelve index time series describing factor input costs in the mining sector of 95 countries. The twelve index time series describe the costs of: 1) mining wages, 2) construction wages, 3) equipment and repair parts, 4) bits and related steel, 5) timber and lumber, 6) fuel, 7) powder and blasting agents, 8) tires, 9) construction materials, 10) industrial materials, 11) transportation, and 12) electrical power. These indices combined with weight factors being developed by the personnel of the Minerals Availability Field Office (MAFO) of the Bureau of Mines in Denver, Colorado, will be used to perform instantaneous updates of all costs relating to the mining industry. The indices were developed primarily for use in the Bureau's Minerals Availability Program in assessing the worldwide availability of nonfuel minerals.

"There is certainly no argument that LED lighting systems have taken a strong foothold in the lighting marketplace over the last several years. This has even proven true in the world of transportation and transit lighting, for which new LED cobra head style luminaires are replacing traditional HID cobra head luminaires on North America’s roadwaysand linear LED light fixtures are replacing conventional linear fluorescent light fixtures in North American rail transit facilities. However, LED technology has taken a while longer to penetrate the very specific market of vehicular tunnel lighting in this continent. Though both the New York/New Jersey Holland and Lincoln Tunnels have recently been retrofitted with LED lighting, and an LED Lighting RFP is currently out for Boston’s Central Artery Tunnels, very few vehicular tunnels in North America to date have been illuminated with LED light fixtures. This is largely because cost effective LED lighting, that met our typically stringent tunnel lighting standards, was until recently simply unattainable. However, with the rapid advances in LED technology over recent years, owners and specifiers of North American tunnel lighting projects have finally begun to adopt LED lighting systems as the norm. In fact, a recent Lux Fit/Yole Development “LED in Road and Street Lighting Report” stated that “LED luminaire growth will be driven firstly by tunnel lighting, and then relayed into highway, road, residential and amenity lighting applications starting in 2014.” 1 Our highways are continually becoming more congested. As a result, Provincial and State Departments of Transportation (DOTs) are constantly looking for innovative ways to improve traffic flow. One way DOTs are now helping to ease congestion is by expanding the use of tunnels and long underpasses in large interchange reconstruction projects. With less available right-of-way to work with, and the high costs of maintaining elevated bridge structures over the years, it often makes more sense to “go under” (rather than over) the traffic congestion points. With the addition of these new tunnels and long underpasses comes the issue of proper illumination within these structures, for a safe and efficient driving task. DOTs use recommended lighting practices and guidelines for highway lighting, which include specific criteria for tunnels, set by either the Illuminating Engineering Society of North America (IESNA) or the American Association of State Highway and Transportation Officials (AASHTO). However, both IESNA and AASHTO point out that these recommended practices and guidelines are not a mandate, and DOTs are free to make their own decisions about lighting criteria. Accordingly, effectively illuminating tunnels is often times a challenge. This paper will examine the key considerations of the tunnel lighting application in generalas well as what LEDs now bring to the table and how, accordingly, traditional lighting technologies will be phased out in the future illumination of tunnels."

An investigation of the production of iron in the blast furnace is obviously not an easy subject for research . Enough is known of the mechanical , thermal and chemical conditions existing inside the furnace to say certainly that they are complicated. Furnace operators have found that the process is sensitive to a number of known and to many unknown operating conditions . In order to form any conclusions of value , it seems necessary to collect a large amount of data taken with considerable care and accuracy. These facts make a blast furnace research difficult but not impossible . The most serious obstacle in attacking the problem comes from the fact that it is useless in the design and operation of the blast furnace to use the method of " trial and error , which has proved valuable in so many other industrial problems . The variables are so interrelated and are so dependent one on the other that the number of experimental combinations to be tried is enormous . There are certainly not less than twenty factors in furnace operation and design that are known to influence the results . This is apparent if it is remembered that a phrase like " size and shape of the furnace" includes height of the furnace , height , diameter and angle of the bosh , inwall batter , stockline diameter , and furnace volume ; and that a phrase like " chemical and physical properties of the fuels charged " includes size and shape of the lumps , density, porosity and strength of the coke , in addition to its chemical analysis . Let us suppose that we need choose for each of twenty factors one of two values , for example , suppose we must say only that the furnace shall be " tall " or " short , " that the bosh angle shall be " flat " OF "steep , that the ore shall be " coarse " or " fine , " or that the blast has to be "hot" or " cold , " the number of resulting combinations is more than one million . In putting twenty pennies on the table , either heads up or tails up, the number of permutations possible is the twentieth power of two , slightly more than one million. It is obvious , therefore , that some sort of mathematical relationship , a set of rules of thumb , laws , curves or the like , are needed . Whether the relationships , curves or formulas are derived from experiment , from theory, or from mere guess -work, makes no difference provided they agree with the known facts . If they do not agree with known facts , they are worthless no matter what their origin or how weighty the " authority" vouching for them. Few such relationships have appeared in blast- furnace literature , and it may be doubted whether such formulas can be discovered .

Let's start with a bit of History. Before the advent of woven wire screen cloth or perforated plate as we know it today, screens or sieves, as they were called, were probably made by the Greeks or Romans around the year 150 B.C. Coarse openings were made from bamboo or other woven reeds or with holes punched in leather hides, while fine openings may have been made using hair from the long tails of horses woven with small openings. The first metallic woven wire screens were probably produced by the Germans in the 15th Century. All of these screening devices were, of course, hand operated. The first records of mechanically driven shaking screens are found in "John Smeathon's Diary of His Journey to the Low-Country" in 1775. He was the English Civil Engineer who built the famous Eddystone Light House and discovered the formula for making hydraulic cements. He described a screen the Dutch were using as a wooden frame on which woven wire was mounted. This box was inclined at an angle and hinged on the lower end. The upper or feed end was equipped with a pulley so they could raise it up, say 5" or 6", and then let it drop abruptly onto a sill or stop plate, thus jarring the material deposited on the woven wire through the openings. Material that was passed over the deck was scooped up and redeposited on the woven wire for rescreening. This was an early form of what is today known as a recirculating load.

This profile study of the commercial secondary aluminum industry examines not only the elements that form the industry but also the technological contributions of each toward industrial growth. Concise descriptions of processing methods trace aluminum scrap from generating sources to marketable industrial and consumer goods. Economic and marketing appraisals are used to illustrate the impact that recent technology has had upon the secondary aluminum industry. Price, supply, demand, competition, and substitutes are selected as components of an economic model of the secondary industry and are used to illustrate the aggregate effects of technological changes. The final section is a conceptual look at the future in which sensitive economic indicators (such as die casting in the automotive and appliance industries) are examined as well as the problems of conserving mineral resources by retrieving secondary aluminum from solid waste.

Gases and vapors given off by petroleum and its products have long been recognized as somewhat injurious, when inhaled in high enough concentrations. The petroleum industry has recognized these effects and has tried to minimize the possibility of employees encountering dangerous concentrations of the vapors. Petroleum gases and vapors have not, however, been considered as actively poisonous, in the sense that hydrocyanic (prussic) acid and phosgene are poisonous; men have been exposed to them repeatedly, and for long periods, without any marked ill effects. Light Mexican crude oil when first introduced into the United States for refining was handled in much the same way as was customary with other apparently similar crudes; but experience soon showed that some toxic substance escaped from the crude during production and transportation and in most of the refinery operations. After a preliminary investigation several of the larger companies decided that the gases from the petroleum were the source of trouble, and therefore took precautions, wherever possible, to protect the men from exposure to these gases. With the increasing use of Mexican crude, this problem has become important. The present report covers the work done on the subject by the Bureau of Mines and the Public Health Service under a cooperative agreement with the American Petroleum Institute.

The history and experience of early companies in the Islands is illustrated by the typical transactions of Trans-Western from 1959 to date. Trans-Western had entered into farmout agreements with companies strong enough to carry out at least the required minimum exploratory work and then such development as might be warranted. The farmee companies were required to make deposits to guarantee work performance during the first period of validity, i.e. the first 3 years of the 12-year life of the permits, and at the rate of 5 cents per acre. At that time, a good deal of geology was available, as a result of extensive exploration that had been carried on by the Geological Survey of Canada and other geological enterprises, with field parties travelling over and camping on all of those Islands. Trans-Western's farmees then selected, from Trans-Western's priority on 13.5 million acres, what they believed were the lands most prospective of producing large oil and gas discoveries, and, having the right to trim off acreage which they considered less prospective, thereby reducing the acreage of Trans-Western and its farmees to in excess of 5.5 million acres. The farmees then commenced a 3-year program carrying out geological exploration to the required minimum of 5 cents per acre, and with some permanent and many mobile camps.

Every mineral project or mine is based on a geologic entity-an ore (mineral) deposit. A well-defined mineral deposit and its associated geologic characteristics are the only aspects of a project that cannot be altered. Mine plans can be modified to exploit the deposit using alternative approaches and yielding similar results. A variety of processing methods also are often available producing generally comparable results. Major modifications can be made to other aspects of the project without substantially changing project economics. However, all engineering and metallurgical aspects of a mine must be accommodated to the spe¬cific location and geologic characteristics of the deposit. Geologic data and interpretations form the foundation for both mine evaluation and mine production by providing esti¬mates of reserves and essential information for mine planning and process design or control. Proper geologic work requires a keen awareness of and an ability to anticipate the technical requirements of geotechnical engineers, hydrologists, mining engineers, metallurgists, and other specialists. The mining industry of the United States has long been severely criti- cized because of its high rate of accident occurrence, not only as compared with other industries of the United States but also with the mining industries of other countries, particularly Europe. Statistics, often not strictly com- parable, indicate that the accident-frequency rate in all mining is currently about three times and the accident-severity rate is about seven times as great as the average for general industrial work in the United States. These fig- ures are by no means comforting to humanitarian mining men, irrespective of their status in the industry, and they constitute a challenge that certainly cannot continue to be ignored much longer. The picture becomes much darker when the above statistics are augmented with data indicating that on an exposure basis our mines (more particularly our coal mines) have accident rates two, three, or even more times as great as more or less similar mines in Europe, particularly England, Wales, Belgium, France, and Germany. The sting is alleviated to some extent by the knowledge that our coal mines produce about 4 to 5 times as much coal per man day as is produced in at least some European mines. However, all of these foreign acci- dent statistics should be analyzed carefully before we become very much con- cerned about them, because they are not strictly comparable, for several reasons, not the least of which is the fact that foreign methods of compiling or recording accident statistics often differ materially from ours. Moreover, foreign mining and other conditions are definitely dissimilar to ours in many phases, and numerous other factors affect the comparability of foreign mine- accident statistics with those of the United States. Unquestionably, it should also be taken into consideration that the accident rate of the 140,000,000 or more constituting the populace of the United States as a whole is much higher than that of any other major country in the world and is two, three, or more times the rate of the European countries that have more favor- able mine-accident rates than those of the United States (table 1). Moreover, it is significant that the mine-accident-severity rate of British mines is about six times the average accident-severity rate of the major industries of the British Isles, or but little more favorable than the comparable figures in the United States; namely, that mining has an accident severity rate about seven times the average of about 30 of the major industries of this country.

"Repairing and replacing the nation’s aging and crumbling infrastructure has become a major issue with the American public. It is no secret that the upkeep of roads, tunnels, bridges, and water and waste water facilities has been neglected for decades. Cities, states and towns across the United States are now grappling with these issues, ones that will take decades and billions of dollars to fix.Because of this infrastructure issue, the North American tunneling industry is flourishing. Cities across the country are looking to go underground to alleviate traffic issues, transporting water and waste water to more people in more efficient ways.In October, the seventh annual Cutting Edge conference was held in Atlanta, GA. Put on by the Underground Construction Association of SME and Britain’s Tunnelling Journal, about 175 tunneling and underground construction professionals from around the world attended. Attendees included owners, designers and contractors. An accompanying exhibit included 28 companies.The theme of the two-day conference was Advances in Tunneling Technology. Speakers examined the latest advances in tunneling technology, its methodology and how these advances can be harnessed to assist upcoming major tunneling projects. The conference featured a tailored, high-end, single-track program of subject-specific presentations that focused on innovation and practical experience. Two in-depth panel discussions at the end of each day were also included.Patricia Mulroy was a keynote speaker on Monday. She is senior fellow for climate adaptation and environmental policy at The Brookings Institution. Like many others, Mulroy believes the U.S. infrastructure in in a state of disrepair. But, she said, no one wants to talk about it. “We need to have a conversation about infrastructure. We cannot be afraid to talk about building it and the cost.” For this to happen, though, the nation needs leadership."

THE engineers of Illinois have been submitting to the State Geological Survey an increasing number of requests for advice on their geological problems, including landslides, unequal settling of fills, laying pavements across peat bogs, shattering and heaving of pavement by frost action, etc. The authors discussed the behavior of landslides, their effects, their causes, a tentative classification, and remedial measures. In the latter connection the efficacy of drainage and how it should be handled in order to be most effective was considered. The principles and efficacy of other remedial measures, such as subsurface blasting, rock anchoring, installation of wood, concrete or steel piling, construction of retaining walls, construction of cribbing and reduction of slope were also discussed. Attention was also given to the matter of applying geological knowledge to avoid undesirable highway locations, and a specific example was cited.

The Bulletin. As already announced in the January Bulletin, this publication will be issued during the coming year monthly instead of bi-monthly as heretofore. Among other reasons for this change, it is desired to effect thereby the earlier transmission to members of important papers, lists of candidates for membership, and other items of timely information. The New Haven Meeting. As already announced in special circular, the XCVIth meeting of the Institute for the reading and discussion of papers will be held at New Haven, Conn., beginning Feb. 23, 1909. The Secretary of the Local Committee is Prof. J. D. Irving, Box D, Yale Station, New Haven. The program embraces visits to many interesting works in New Haven, Ansonia, Bridgeport, etc. The leading topics for discussion at the sessions will be: The Conservation of Natural Resources; A Sea-Level Canal at Panama; and The Technical Education of Mining Engineers. But papers on other subjects also are announced. A supplementary session of this meeting will be held in New York City, at some time during March, 1909, as a joint session with other national engineering societies, for the further discussion of the subject of The Conservation of Natural Resources. A Pacific Coast Meeting. The XCVIIth meeting will be held on the Pacific Coast, including a visit to the Exposition at Seattle, and various other points en route going or coming, depending upon the route and program finally adopted. More definite information will be announced at the New Haven Meeting, or at the earliest possible date thereafter.

AT the Annual Meeting of the A.1.M.E. last February, Cornelius F. Kelley, chairman of the Anaconda Copper Mining Co., was presented with the Charles F. Rand Memorial Medal for "conspicuous success as administrative head of great enter- prises engaged in the production of nonferrous metals at home and abroad; for inspiring leadership of an organization that has trained able engineers for service wherever ores are mined and metals are recovered; and for enhancing the prestige of metal mining in the financial and industrial world." Mr. Kelley's acceptance speech follows: I am not unmindful of the fact that the distinction is not to be considered a personal one, but that by the language of the citation itself it is rather a recognition of the service that has been performed by the many trained men of an industrial organization that in the arts of mining and metallurgy and in the fabrication of metal products has performed a distinct service to the industry and to mankind. In that spirit, the award is accepted, and on behalf of the organization I represent and myself, I thank you and assure you that the honor is deeply appreciated.

Limestone and dolomite are the most common rock types mined and quarried as industrial minerals in the United States. In 1993 over 720 million tons of limestone and dolomite valued at over 3.1 billion dollars were extracted and consumed throughout the nation. While the greatest volume of this vast production is used as aggregate for construction purposes, few people realize how critical limestone and dolomite are to our food chain and our national goals of clean air and water. Limestone, including dolomite, can truly be called nature's gift to the environment. Without a reliable, economical source of limestone the quality of our environment would be severely comprised and the standard of living of our citizens dramatically reduced.

Edgar Hall, Silverspur, Queensland, Australia (communication to the Secretary*):—Dr. Douglas has written on this subject before, and his influence has had a powerful effect on the eide of freedom among the' younger generation of engineers. Moreover, it is not the first time that he has attributed the decline of the copper-smelting industry in Swansea to the secrecy maintained by the firms there engaged in smelting-operations. In this latter statement I think his conclusions are open to criticism. Whether the firms mentioned have suffered by their secrecy is their own business—I hold no brief for them ; but that the decline of the copper-industry at Swansea was inevitable seems to me to he proved conclusively by Dr. Douglas's own writings. In his paper on The Copper Situation,' Dr. Douglas says : "In comparing iron and copper mining,...it must be remembered that 2 tons of average iron ore from the most prolific source now available ... will make 1 ton of metal; whereas from 33 to 75 tons (say an average of 50 tons) of copper ore must be mined to produce 1 ton of copper." And further: "Last year's production of iron was made from approximately 50,000,000 tons of ore. Our copper mines, to yield a production of 900,000,000 pounds, must have handled approximately 22,000,000 tons of ore, or nearly half the quantity raised from our iron mines." Is not this the key to the whole situation ? In transporting the 50,000,000 tons of iron-ore, 25,000,000 tons of the metal iron were carried so much nearer to the market, but the transportation of 22,000,000 tons of copper-orc would have carried only 450,000 tons of the metal copper nearer to its ultimate destination. Energetics has been in the business of climate change for more than twenty years. This experience has only served to cement the understanding that decisions taken during design define the environmental and economic performance of any project. The 80-20 rule definitely applies, with 80% of a project’s performance being set through the first 20% of design decisions. This in depth knowledge is used for determining energy price forecasts, future carbon markets and carbon costs, current and future energy technologies, as well as giving a thorough understanding of the processes and technologies in place in the mining industry to work out what the most carbon and energy sensitive decisions during design are. Project selection and design is a gated process where decisions are taken in line with the information available at that point in the evolution of the project. Design decisions are, by their nature, dominated by uncertainty. In order to ensure that robust decisions are taken, it is necessary to ensure that the correct information is brought to bear at the correct decision point. This then defines and supplies the necessary carbon and energy information for design decisions to be correctly made. One of the most significant risks facing design engineers and decision makers in the mining industry is the future cost of energy. Part of this risk is associated with a future cost of carbon, however, a significant part of this risk is the cost, and variability in this cost, of the energy itself. This paper investigates the information required to support good decision taking during the design process.Project Managers and MetPlant Operators accept poor quality evaluations because they are generally unaware of what they should expect.The 2010 draft AusIMM ‘Guidelines for Techno-Economic Evaluations’ were collated by a subcommittee of practitioners and are regarded as best practice.They apply directly to projects and metallurgical plant evaluations, including those with a heavy technical basis. They can be applied to technical problem solving where there are no monetary computations.Project Managers and MetPlant Operators should demand that economic models and evaluations follow the six principles. They should become working tools which are easy to understand, fit for purpose, consistent, rigorous, record sources of input data, have key graphs and are rapid to audit.

IN MAY, 1930, G. LaBine and E. C. St. Paul, prospect¬ing round the southeastern shore of Great Bear Lake, in the North West Territories of Canada, discovered pitchblende at what is now LaBine Point. At the same time, they also found native silver in a small sheared break on an island lying off the point. Late in 1930, samples of the pitchblende were sent to the Mines Branch, at Ottawa. The material consisted of several fair-sized slabs of botryoidal pitchblende banded with a brownish quartz. A small amount of chalcopyrite was visible as small particles and fine veinlets, and the pieces were rather heavily stained a yellowish-green by secondary copper-uranium salts. Analyses were run in the Mines Branch Ore Dressing Laboratories on two samples, and small-scale concentration tests were made on one of them. The results of this work were published in a Memorandum Series report (No. 48) of the Mines Branch, in March, 1931.
