9:00 a.m., June 28, 1983 MR. MORTENSEN: Good morning ladies and gentlemen. Again, it gives me great pleasure to welcome you to another session of the 79th meeting of the Rocky Mountain Coal Mining Institute. The thing again that has always been impressive are the activities that we've had so far. The success in the meetings has been delightfully encouraging to all of our committee people. Please welcome the chairman of the session, Charlie Margolf. MR. MARGOLF: Thank you, Vernal. Good morning, ladies and gentlemen. It would be my privilege to serve as the session chairman this morning. To allow the maximum time for our speakers, I'll turn the microphone over to Bernie Bernstrom who will introduce our first speaker. MR. BERNSTROM: Thank you. As Vernal mentioned, Dan Jackson will be our first speaker. He is the Western Editor of Coal Age Magazine. Dan really doesn't need an introduction to this group. He's belonged to the Rocky Mountain Coal Mining Institute about 25 years. Dan is a native of West Virginia and he's an ex-coal miner. He graduated form West Virginia University as an electrical engineer and worked for Amherst and West Bending Coal prior to employment by Coal Age Magazine. Back in 1972 Coal Age moved him to Denver from New York City. MR. JACKSON: When Vernal Mortensen asked me speak to the members of the Rocky Mountain Coal Mining Institute earlier this year I found it impossible to say no to the guy because of what he has contributed to western coal. Little did 1 know that the subject he had in mind would be entitled, "An Outsider's View of Western Coal." At first I asked myself-I've been associated with the coal industry for some 38 years, 12 years in national operations and 26 years reporting on it. You might say that I've been married to two industries, coal and the business press for 26 years, but today I'll put on my business press hat and try to make an impression of what an outsider might think of western coal. But at the outset, let's get one thing straight: When you say press, whether it's business press, the media or whatever, and you heard some comments yesterday as far as what the media has done .to this industry and there's been some definitions bandied around as to just what an editor is. One of the most recent ones has defined an editor as a person who can talk on any subject with an open mouth. Now that's not my case. Secondly, I don't give long talks. Several years ago I was giving a rather lengthy talk to a group similar to this and it was halfway through the talk when I noticed one guy on my right looking at his watch quite frequently. I didn't mind that too much because all of us do that once in a while, but when he looked at his watch, took it off and shook it, I thought, "My God, better cut short." But for more than a decade western coal has enjoyed substantial annual increases in production from some 30,000,000 tons in 1970 to some 264,000,000 tons in 1981, but 1982 was a different story. We lost about 6,000,000 tons of production in that year. In 1983 it's expected to be a little worse than '82. Coal historically doesn't rebound from a recession as quickly as other industries. It takes about eight to 10 months longer for us to really get moving again and I'm afraid that you'll still have to don your fighting helmets and flack jackets when you go out into the market to sell your product. Western coal, as you know, has problems and al l of them are not going away when the recession ends and they won't go away overnight. I'm sure most of you are aware of what those problems are. Carl Bagge and Jim Harris, along with other speakers, at this meeting have educated us well on those problems and I'm sure you'll hear more from Jim Watt at today's luncheon. If everyone in this room were asked to list three orfourof the most serious problems facing western coal, I'd make book that the total of the answers wouldn't vary by more than 3 to 5%, if that much. But coal is not the only mining segment in the U.S. with problems. Metal and non-metal mining has its share, too. I'd like to step back into the past for a few minutes, if I may, to a time when our problems were just beginning. Since 1979 a third of the nation's mines, including coal, metal and nonmetal have been shut down. The total volume of all mining in the U.S. in that year totaled some $24 billion. Today that figure has dropped some 21 %. The after tax rate on return for mining companies has fallen from 6'/% in 1980 to minus 3% in 1983. But that's really not where our problems began. They began 20 years ago when a profound change began taking place in the U.S. economy. Our economy had been growing at about 2'/-3% annually without exception except for the great depression. Our inflation rate was about I'/%, interest rates were running about 6%, and the federal budget was $77 billion, really great figures compared to today. From 1960 to 1980 the federal budget increased almost 1.000% and taxed paid by individual families increased by 700% during that same period. Despite the huge increases in taxes, the federal deficit kept getting larger and larger year after year and within this 20 year period the national debt climbed to a trillion dollars. Economic progress of this type can't continue indefinitely without some serious consequences. The result of that economy, well, you know what happened and there is a direct relationship of that

Before we look at what the challenges and opportunities for future coal mining will be, it is appropriate to have a look at whether there will be a coal industry in the future. There is much talk about the damage caused by the burning of fossil fuels and the need to replace coal and oil with more environmentally friendly energy sources. Yes, there is evidence that the current practice in burning of fossil fuel has certain negative environmental effects, however, the adverse effects for global economic development from inappropriate measures to control greenhouse gas emissions would be severe.

The Role of the Drilling Contractor BY FERRIS E. SAINSBURY Ron Haxby, Occidental Minerals What is the best method for drilling a 12-in. diam hole to a depth of 1200 ft and maintaining the deflection within 25ft from vertical? Ferris Sainsbury: In order to drill a 12-111. hole down to 1200 ft, In most places you would have to employ a rotary tricone bit With a down-the-hole hammer, I expect by that depth significant Inflows of water would be experienced Even with foams, we would not be able to get the water out of a hole of that diameter So the down-the-hole tricone method of drilling would be best. To keep it straight, we would probably employ the largest square drill stem compatible with the diameter of the hole. Ron Haxby: Is it common in drilling contracts to put in a vertical hole clause? Ferris Sainsbury: You can put in the vertical hole clause Ron Haxby: Does it cost more? Ferris Sainsbury: Normally, if the hole deviates, the driller can correct it with deflection wedges and will charge it back to you at cost, plus 10% or somewhere along that range Any drill hole has a tendency to go perpendicular to the dip, and there are times when stabilization systems are not successful in preventing the hole from turning into the dip of the formation. The only solution, in this situation, is to go in with an oriented wedge and kick the hole back out.

The mining industry is in the midst of dramatic change. Mining activities are moving from industrialized first world countries (Canada, Australia, and the United States) to the third world. This shift is occurring due to depleted reserves, tough environmental standards, and expensive labor in traditional mining countries. During a recent trip to South Africa, I was asked, owing to my educational background in economics and an international involvement in drilling and blasting, what changes could be anticipated in third world blasting practices as labor costs increase. It is from that beginning that this presentation has evolved.

There remains considerable controversy in the industry regarding precision type detonators and where the end user can benefit from their use. In spite of the fact that electronic detonators and other prototypes were tested over one decade ago, explosive suppliers have hedged on full scale production for many reasons. Although some of the reasons were based on solid economics, others were strongly influenced by shear internal resistance within the corporate objectives, ultimate fear of market rejection, indecision as to what degree of precision was required and limited data on defining the real benefits to the end user.

James, Jones, and Leak (JJL) conclude that growth-rate and orientation-distribution data obtained in a steep thermal gradient should be used with caution to account for isothermally produced recrystallization textures. Gas well tests were performed on 17 wells in the Roma area. The procedure used in the test programme incorporates an initial isochronal test followed by what is described as the "two flow drawdown" technique. The second flow of the two flow drawdown test was conducted for sufficient time to allow transient investigation of the surrounding reservoir. This combination of tests allows the evaluation of stabilized production capacity in addition to the determination ,of several important reservoir characteristics.It also provides a qualitative indication of reserves, by reflecting the presence or absence of reservoir boundaries within the drainage area affected during the test.

Everybody has an opinion what the quality of a grinding mill head casting should be, yet extremely few take the time, or get the opportunity, to compare their opinions against fitness-for-purpose data. The real question is not how flawless the casting should/could be, but rather how long will ?this? casting survive in operation. To validate an opinion on this topic one needs either extensive historical data, or comprehensive experimental data, or preferably, a combination of both. The same data can also be used to establish the conservativeness, or lack thereof, of analytical prediction methods.

"1.1. WHAT ARE AGREEMENTS AND HOW ARE THEY FORMED?In order to have an agreement, at common law, there must be an offer, acceptance of that offer, and consideration passing between the parties. In addition, the material terms (i.e. the basics or substance) of the agreement must be discernible, preferably by means of documentation. Although these concepts may appear simple and straightforward, the law relating to them is voluminous and complex. Some brief comments are worthwhile.• Offer/acceptance: Both offer and acceptance should be in writing, but they need not be. The actions, conversations, and/or correspondence of the parties may constitute either or both of them. Notwithstanding, the local law or practice of a jurisdiction will impose some specific requirements for certain types of agreements. If these requirements are not met, the agreement may be unenforceable. For example, Ontario’s Mining Act requires transfers of unpatented mining claims to be evidenced in writing and recorded.1• Consideration: Consideration is usually thought of as being money, but it can be virtually anything, even “the premises” (i.e. the mutual covenants or promises contained in the agreement itself). In addition, if one party, relying upon the offer of another, does something to his detriment, then the doing of the act can be considered to be an acceptance of the offer and, under the legal concept of “detrimental reliance”, can also be consideration. Whether or not detrimental reliance exists will depend upon the circumstances of each case.2• Material terms: The requirement that the material terms of an agreement must be discernible does not mean that all of the terms of an agreement must be documented or even have been considered, just the basic or material ones. In addition, it will be up to a judge to decide what is material – not necessarily the parties. In order to establish the material terms, a Court may look at all relevant documentation and may hear oral evidence. It will resist “writing the agreement”"

The minerals industry consumes billions of dollars in raw materials, equipment, tools, services and chemicals. The industry, though, has turned overmuch of the research and development (R&D) for these products to manufacturers and suppliers. Now the industry and its suppliers must decide how much R&D the mining industry should be responsible for and what role the suppliers should play. Promoting R&D As a result of the current environment in the mining and minerals industry, there has been a substantial decrease in R&D. Depressed prices, stagnant growth, cost cutting and rationalization are evident.

The founder of social psychology is sometimes identified as Kurt Lewin. In a 1947 article, Kurt Lewin coined the term ‘group dynamics’. He described this notion as the way that groups and individuals act and react to changing circumstances. Lewin theorised that when a group is established it becomes a unified system with unique dynamics that cannot be understood by evaluating members individually. The discipline of social psychology really emerged out of World War II and tackled questions associated with human judgement and decision-making by the Nazis. For a comprehensive look at the development of social psychology look at Abelson, Frey and Gregg (2004).Social psychology is concerned with the way social arrangements affect human judgement and decision-making. What the author has done is apply the knowledge of this new discipline to an understanding of risk, safety and leadership. This paper will explain some of the developments in social psychology, such as the discovery of the bystander effect, Groupthink, bounded rationality, heuristics, risk homeostasis and the Milgram effect.The social psychology of risk tackles the way decisions are made about risk in their social context. Unless organisations understand that decision-making is socially conditioned, they are unlikely to be able to tackle the complexities of culture change or the development of risk maturity.The paper will offer a new understanding of why people do what they do, how risk makes sense and why a ‘dumb down’ approach to safety is dangerous. MR. McKEEVER: I think we had to start some- where. The proceeds of the beltbuckles and hard hat stickers will certainly be a beginning in a scholarship for some of our young people. And maybe, you know we might even get one of them sometime to go to the University of Oklahoma. A few years ago the luncheon speaker for tomorrow, Brooks Mitchell, got a few of the mine presidents together and we spent a full five hours of just dedicated listening to Carl Terzian. We listened basically on three subjects: how to work with the media, how to work with image, and how to identify with our political systems and those who are in them. I remember that as one of the turning points in my perspective on how our system really works. This gentleman who will be addressing you today, Mr. Terzian, will be conducting about a three-hour session tomorrow. And it's a shame that our other activities will not allow some of the golfers to probably be there. Those of you who can come to the session tomorrow morning will find it most rewarding. A little bit later on we will also have a panel session. And I see all of the panelists are here except for Bob Golten, but I understand that he is registered. We should have a full afternoon session with Charlie and his panel. When we started working on this, we naturally went back to Carl Terzian to give us some guidance. If there is anything wrong with your session, it's my fault because he knows how these should be done and he guided us along the way. One thing that I am sorry, it wasn't his fault necessarily, is that Harry Reasoner will not be with us for lunch tomorrow. Brooks Mitchell is going to make all of the PR he can out of the fact that Harry got scratched and he got in place for him. Brooks gave me one comment along that line. He said, "Do you know what you get when you cross a gorilla with a computer"? Of course I bit on that. He said. "Well, you get a Harry Reasoner." A little over a month ago I was invited out to California to Woodbury University at Carl Terzian's insistence. I happened to be sitting by one of his vice presidents. It was a formal affair. We had to wear tuxedos and everything and Mr.Green was sitting there and he said, "You know," he didn't know who I was at that time, but he said, "You know Carl really didn't want this formal affair. Said he had a couple of friends coming from the coal mining industry and they wouldn't know what to do with tuxedos." So with that Carl, we will start this little session and it's your mike. MR. TERZIAN: Thank you very much Ira. Let me begin by expressing my appreciation to the men and women of the Institute for allowing me to be here. I'm deeply concerned about my reputation, my image and don't want you to get the inference that I am responsible for Ira McKeever's image. Nobody could be responsible for that! But it is a great case in point that we all should be concerned about our images. I guess tomorrow morning from about 8:30. a.m. to about 11:30 a.m. we are going to do a? hopefully, a productive and very pleasant expertence for all of us in this growing field and great interest that people have in the area of image. I happen to be from Los Angeles. I have a national firm which has handled about 600 corporations', over the years through the areas of public relations,' community, civic involvement all built around a strengthening and safe guarding our precious, free enterprise system. "8.1. INTRODUCTIONThe purpose of this chapter is not to provide precedents or examples of provisions, but rather to offer some comments that may be worth considering in the negotiation or review of an agreement. These comments are not intended to be exhaustive. It must also be noted that, although the chapter is written in the context of a common law joint venture, the concepts and concerns for the most part apply equally to a corporation that is owned by only a few shareholders for the purpose of participating in the project held by the corporation.The corporation has the advantage of having much of its organization established by local corporate law, but the particular wishes of the shareholders will appear in a shareholders’ agreement. The principal differences will be surprisingly small, save for the acquisition provisions that appear in a farm-in agreement1 and the substantial portion of the joint venture agreement devoted to creating and organizing the joint venture entity. Where the joint venture agreement refers to venturers and committees, the shareholders’ agreement will refer to shareholders and the board of directors, but both will have to deal with such basic matters as decision-making, default, dispute resolution, first refusals, funding, and carrying out work on the project. For convenience, this chapter usually refers to “venturers”, which may be taken to include shareholders.Negotiations give rise to many varying circumstances and concerns, and the main asset of the negotiator is an open and flexible mind. A desired result can often be accomplished indirectly in circumstances where the other side has adopted an inflexible position on a suggested approach. As precedents and standard forms tend to focus a negotiator’s thinking, they can be counterproductive. It is after the deal has been agreed to that a precedent can be of great assistance to the draftsman.The concepts are arranged in alphabetical order for convenience, not to suggest their sequence or position in an agreement or their relative importance. An agreement should adopt a progression of subjects in what the parties consider a logical sequence to read and work with. However, experience has indicated that it is best to set out in a single article the substance of the deal (i.e. the terms relating to the farm-in and what the acquiring party has to do to acquire his interest), preferably near the beginning of an agreement. The acquisition of the interest is, after all, the first order of business. The joint venture provisions will then follow in a reasonable sequence. It is also worthwhile to devote a single article to any special provisions that may apply during the earn-in period. For example, it may be provided that, although all work is to be done by the acquiring party as operator (with the duty of care, liability, and reporting requirements as set out in the joint venture sections of the agreement), but during the acquisition period, the acquiring party, acting as operator, may be at liberty to do such work as he wishes, without the need for any committee or other approvals, and committee meetings may be suspended.2An agreement is divided into paragraphs and articles to make it easier for the parties to read and understand, and to assist a party in finding “that provision” when the need arises. A comprehensive table of contents will also assist the parties who must work under an agreement. An added benefit of a table of contents is that in preparing it, the draftsman sees the overall structure of the agreement and will often catch and correct flaws."

This report presents findings from a Bureau of Mines study on barriers that may prevent miners from correcting and avoiding groundfall hazards. Such barriers stem from four basic types of problems: (1) inability to recognize groundfall hazards, (2) inability to correct groundfall hazards, (3) lack of motivation to search for groundfall hazards, and (4) lack of motivation to correct groundfall hazards. Data are presented that summarize the views of miners, section supervisors, and mine inspectors about the contribution of these barriers to groundfall accidents and what they think should be done to reduce the frequency of injuries sustained by falls of roof and rib. The report also includes a summary of miners' responses concerning their recent experiences with groundfall accidents, along with industrywide statistics on accidents and injuries caused by ground falls in underground coal mines.

PlannersÆ optimism (or maybe commercial necessity) means that most mine plans use equipment rates that are rarely achieved (Lumley and Beckman, 2009). This lack of understanding of what equipment actually moves is causing erroneous equipment forecasts, leading to incorrect mine development plans and economic evaluations. Compounding this problem is a downward trend in actual equipment performance in some areas. Consequently, the presentation of realistic mine plans that are actually achieved in practice is not a common occurrence. However, rational, fact-based mine planning is available to those who want it. Hundreds of millions of cycles of data from open cut mining equipment has been collected from mines around the world since 1992. This unique and highly valuable databank is growing at an exponential rate and is being used by a number of our big miners to support rational and fact-based decision-making. However, neither the use nor the appreciation of the value of this data is universal. There is a challenge to everyone in the mining industry - how do you access value from it? The databank was drilled into and the results analysed for, the Australasian Mining and Metallurgical Operating Practices (AMMOP) publication (Lumley, in press). For this paper the analysis has been extended to include interpretation of trends for draglines, shovels, excavators and trucks. It investigates trends between coal and non-coal mines and across geographic areas. It is known that mining equipment performance in most sections of the industry is falling. This paper attempts to quantify the fall and provide explanations. The trends are analysed to extract the reasons behind the changes and most importantly, what can be done about it.CITATION:Lumley, G, 2012. More than eighty years ago, in what we generally consider a more leisurely age, workers and engineers began the construction of the longest railroad tunnel in the world. When completed, the Simplon Tunnel ran more than twelve miles through the alps to connect Switzerland and Italy. Work began in 1898 and the tunnel was completed in 1905. In all it took about seven years to build one of the world's great tunnels. More than seven years ago, in what was hoped to be a rapid and constructive to the deaths of 38 workers in two spectacular tunnel disasters in 1971, the secretary of Labor's Construction Advisory Committee on Safety and Health began in January 1972 a search for an effective standard on tunnel safety. Much hard and useful work has been done, especially by the construction advisory committee' but more than seven years later, we still don't have a tunnel standard. We may speculate that, when the Simplon Tunnel was completed, workers and their bosses assembled to celebrate their achievement and to count their casualities. We have no need to speculate on the lack of achievement up to this time. An so far as I know, the bureaucrats have suffered no casualities except perhaps some unreported cases of ring-around-the-color. The only moral I can draw from all this is thai it is easier to penetrate solid rock than it is to get through bureaucratic fog. We can only hope that OSHA will finally take advantage of the work which was finished years ago and complete the actions necessary to give us a tunnel standard. THIS is in part a review paper, indicating the various steps that have been taken in developing hindered-settling apparatus, some of the standard data that have been obtained, and some of the conclusions one is led to as to the effect of it in improving concentrating-methods and machinery, and in part it brings in some unpublished work. CAUSES OF LOSS IN ORE-CONCENTRATION. In making a study of the separation of valuable minerals from the waste gangue, particularly by water concentrators, it is necessary to define, first of all, what are the causes of-loss that are likely to interfere with the concentration. Having made this definition; we can then study to see in what way the machines make their losses, and plan remedies for them in an intelligent way. Losses may be stated to occur as included grains, as flat or long grains, as fine free mineral, and as absolute slime. We will take, these up one by one, as follows: Included Grains.-Fig. 1 shows by a set of diagrams how included grains may occur: first, where the heavy mineral grains attached to the quartz are of large size; secondly, where they are of small size ; and thirdly, where very fine particles of heavy mineral are included in the quartz. We have to decide in regard to included grains whether they are rich enough to go direct to, the furnace, or poor enough to throw away, or whether they lie between these two points and require recrushing as the only means of severing the values from the waste. This last case is the only one requiring special treatment at our hands. Large diameter drilled deep foundations are a widely utilized solution throughout North America and the world. Numerous design and construction techniques developed over the past 100 years have made this type of foundation a robust, reliable, and efficient foundation option to support a wide variety of structures. From bridges, to marine structures, to high-rise buildings, drilled shafts are a time-tested approach for all types of infrastructure projects. Yet, what remains ambiguous in the current state of engineering practice is how to respond when a shaft is constructed that, for potentially different reasons, may or may not meet the design requirements? In this case, what are the best practices for Contractors and Engineers when a structural, geotechnical, or material integrity issue arises during construction? In our experience the answers to these questions are not widely known, but are profoundly important so that engineers can have tools available to confidently and efficiently address concerns, and provide a path forward for the project. This paper seeks to answer the above questions by presenting details of different remediation approaches using the results of several case studies where structural and geotechnical engineering methods, combined with non-destructive integrity testing (NDT), were employed to evaluate the acceptance of “questionable” drilled shafts. Through multidisciplinary techniques like Cross-hole Sonic Logging and 3-D Tomography which enhance the resolution of anomalous zones and defects in concrete, the development of concrete strength estimates from non-destructive testing data, and executing innovative structural and geotechnical analyses to evaluate the as-built conditions, drilled shafts that might have historically been rejected were ultimately accepted by the project team. This paper presents a series of unique case studies that together depict a roadmap for a comprehensive approach to reliably evaluate and guide the industry to address these types of drilled shaft construction issues.

Introduction There are times when meditation on the past is worth while. Too often does it happen that in the busy routine there appears t9 be little time for reflection, and little good or benefit to be derived from what has already taken place, or what has become past achievement. Under conditions such as those that prevail at present, consideration is being given to many subjects that a few years ago were not looked upon as worthy of time or thought. The temporary lull in industrial development is permitting of a stock-taking investigation, a perusal of past activities, and a planning for future development with the return to normality. It is not proposed to include much new data in this address, but the endeavour will be made to survey, in resume, the sequence of events which led up to the birth of the mining industry in Canada, and to show how, as new discoveries were made, the centres of interest changed from time to time until mineral development extended across Canada from the Atlantic to the Pacific. It will appear, also, that external causes have accentuated mineral development at one time and retarded it at another. Early Records A, historical background to the mining industry extends even to an earlier date than the discovery by white men of that part of the continent of North America represented by Canada. It has been stated that the aborigines were still in the neolithic stage when the white man arrived. One metal only was known to the natives, and that was copper, obtained from possibly many parts of Canada, but particularly from the shores of lake Superior in Ontario, from the Coppermine river on the Arctic coast, and from die coastal regions of British Columbia.
