THIS furnace is designed especially for the oxidation of sulphur or arsenic in pyritic ores, but may be used for all oxidizing or desulphurizing operations, and for calcining, roasting and chloridizing ores, or for drying ores in large quantities preparatory to treatment by magnetic separators or otherwise. It is of the tabular, revolving type, with automatic feed and delivery, and is a modification of the Cornish calcining furnace, designed by Brunton, from which it differs, however, not only in construction, but in two or more radical features, for which novelty is claimed and patents have been applied for. Table II is of Minerals arranged according to their System of Crystallization The other tablets make no claim to completeness, being limited often to common ah important species. For an exhaustive system of Determinative Tables based particularly upon blowpipe and chemical characters, the student is referred to the work of Professors Brush and Pen- field, mentioned on p. 330.

THE object of this study is to investigate the effect of prior tensile strain on the fracture stress of a metal. This is done in a theoretical manner starting from the point of view developed by the author in his thermodynamic theory of the fracture of metals. The results are compared with experimental findings and a rational interpretation is given to work that shows the variation of fracture stress with prior tensile strain. THEORY OF FRACTURE In the thermodynamic theory of the fracture of metals developed earlier,1 it was shown that a critical strain energy per unit volume exists. This is characteristic of the material and may be calculated from basic thermodynamic data. When the area under the flow curve reaches this characteristic value, fracture occurs. The general criterion for fracture is expressed in the form u ± uo = JLm?AV/V [1] where Lm, is the latent heat of melting of the unit volume, ?V/V is the ratio of the change in volume of the unit volume to the original unit volume on passing from the solid to the liquid state, [uo] is an initial energy density, and J is a conversion factor, which changes energy from heat to mechanical units. As a first approximation, it will be assumed that the stress-strain curve is the straight line that extends from the point of maximum load onward, extrapolated back to the axis of zero strain, for example, line AC of Fig. 1. If the point of intersection of the straight line with the axis of zero strain is represented by so, and the slope of the straight line is p, the analytic form of the flow curve is [s = s + pd [2]] and the strain energy per unit volume evaluated from [JvdS] becomes (vsod + pd2/ 2). When this latter term reaches the critical value JLm?V/V (designated hereafter by M), it is assumed that fracture occurs. This leads to the following expression for the fracture stress: [s1 = \/C r.2 + 2Mp [31] The strain at fracture may be calculated from Eqs 2 and 3. It is assumed in this paper that the initial energy density is either zero or that it may be neglected. Furthermore, the complicated states of stress and of strain existing in the necked region of the tensile specimen after "necking" has occurred will also be neglected for the present, so that average conditions will be assumed to prevail. Mineral Industries education as an entity, again and again has sought recognition, always to be turned aside or ignored.1 The incident mentioned in Lost Chapter was only the first of a series of disappointments. The Land-Grant Act is camouflaged here and there in the name of progressive education. A new interpretation may be in the best interests of society in so far as the goose is not killed that lays the golden egg. The primary objective of the act is still "agriculture and mechanic arts" but mechanic arts is not alone mechanical arts or engineering. Mechanic arts was used in a broad sense as a symbol of creative effort in locating and winning the fundamentals of existence - plants, animals, and minerals - from Mother Earth, their primary processing and treatment into foodstuffs and raw materials of industry, their manufacture into useful articles of commerce, and, last, their distribution and utilization. Significantly the great agricultural industry is now at least half mechanic arts. The Association of Land-Grant Colleges and Universities has neglected the mineral kingdom shamefully. The Association embraces Divisions of Agriculture, Arts and Sciences, Engineering, Home Economics, and Veterinary Medicine but has no division relating to the mineral industries.

A river delivers a given load of sand, and hence heavy materials, into the sea. The load is fixed by drainage basin characteristics and processes. Wave energy available for redistributing that load is fixed in an entirely different way. An equilibrium diagram of these two parameters (load vs energy) pennits a tentative prediction of what will happen to the heavy minerals. Alluvial rivers transport a mechanical load which consists essentially of wash load (finer than about 0.05 mm in particle diam), bed load (coarser than about 0.10 mm) and the transition sizes in between. A few rivers carry no appreciable mechanical load, and are excluded from this discussion. An example of the latter is the Suwannee River of Florida, which empties across an oyster bar into the Gulf of Mexico and does not build a delta despite the absence of significant waves or currents in that part of the Gulf. An alluvial river may deliver its load into a protected sediment trap (such as an estuary, sound or lagoon), onto a low-energy coast (where it builds a delta) or onto a high-energy coast (from which spot the river load is swept away). The nature and disposition of the load depends, obviously, on three sets of factors: 1) drainage basin characteristics and processes, which determine quantity and make-up of the load; 2) coastal structure and geomorphology, which determine the kind of river-sea coupling which

Oxidation rate constants were determined for Cu-Pd and Cu-Pt alloys as a function of alloy composition and temperature. Reaction products were identified. Relationship between oxidation rate constants and diffusion constants in the reaction zones is discussed. THE mechanism of oxidation of alloys is consider--'¦ ably more complex and not so well understood as that of pure metals. The oxidation of a one-phase binary alloy of which one component is a noble metal should logically be the simplest case of alloy oxidation, for in this case one is concerned presumably only with the oxidation of the base metal and the diffusion process by which it reaches the reaction site. This had led a number of investigators to study such systems. Probably the earliest work was that of Tammann and Rienacker' on the tarnishing of Cu-Au alloys at temperatures up to 300°C. These alloys oxidize according to the logarithmic law, that is, the film thickness is proportional to the logarithm of the time. The rate of film formation was found to decrease with increasing gold content. Raub and Engel² investigated the oxidation of Au-Cu, Cu-Pd, Au-Ag-Cu, Au-Pd-Cu, and Ag-Pd-Cu alloys at 750°C in air. These alloy systems form a continuous series of solid solutions at the temperature of oxidation with the exception of those containing silver. Au-Cu alloys oxidize parabolically, the rate constant decreasing slowly with increasing gold content up to about 15 atomic pct* Au, and more rapidly thereafter. An alloy with 14 pct Cu forms only a very thin layer of CuO on the surface and probably also a subscale.† Alloys containing more than 14 pct Cu have scales consisting of CuO and subscales of Cu,O embedded in nearly pure gold. The Cu-Pd alloys obey the parabolic law except for slight deviations for alloys containing 53 and 84 pct Cu. The overall oxidation rate decreases rather smoothly with increasing palladium content. A scale consisting of a thin layer of CuO and a thick layer of Cu²O and a subscale of Cu²O embedded in nearly pure palladium was observed for alloys containing 84, 53, and 30 pct Cu. An alloy with 19 pct Cu formed only a subscale of CuO embedded in nearly pure palladium, and an 8 pct Cu alloy formed only a thin film which was presumed to be PdO. The ternary alloys considered by Raub and Engel oxidized in much the same way as did the binaries. Wagner and Grunewald³ found that Ni-Au alloys, oxidized at 900°C in oxygen, formed a scale of NiO and a subscale containing NiO and gold. The overall oxidation rate increases with increasing gold content, passes through a maximum and then decreases to zero for pure gold. The fact that gold increases the oxidation rate was attributed to "pores" in the scale. Kubaschewski' investigated the air oxidation of alloys of platinum or gold with up to 10 pct Cu or Ni at temperatures in the range 300" to 1550°C. Parabolic behavior was noted for all alloys except Au-Ni, with rates decreasing in the order Au-Cu, Au-Ni, Pt-Ni, Pt-Cu. The diffusion coefficients for the latter three systems are known, and they decrease in the same order. However, activation energies for the oxidation of these alloys do not agree with the activation energies for diffusion in the respective alloy systems. Discussion of the paper of HERBERT A. EVEREST presented at the New York meeting, February, 1916, and printed in Bulletin No. 109, January, 1916, pp. 165 to 167. NEWELL G. ALFORD, Earlington, Ky. (communication to the Sec-retary*).-Mr. Everest's statement concerning the economies in a small coal mine has interested me very much. The majority of discussions on coal-mine economy omit the small operator and for this reason Mr. Everest's paper should lead to productive thought. I agree that close concentration of working places and constructive supervision of labor are two items of salvation to the small operator. It is also true that small mines often yield as much profit per capital invested as their larger neighbors. Mr. Everest also says that the small operator has so keen a regard for the inroad on his profits that even one extra day hand is an extravagance not tolerated, and this is rightly so. But, does not this earmark of the small operator in many cases offer a clue to his vital weakness? A credit balance is the acid test of success in any enterprise. With the small operator who owns practically all the capital stock this is particularly significant. He never takes his eyes off the market price and at the same time strains every nerve to cut down his payroll. In several cases I have noted that the resultant close supervision of labor was in fact too close. The "stitch in time" was not applied to the repair of this or that, with a decided increase to the cost of the work when it had to be done at the expense of cutting off the run when orders were on the books.

Our colleagues cannot in the future earn reputations and medals for achievements in milling and smelting ore and for successful management of mining companies, if some one doesn't keep finding and mining the ore to mill and smelt and to provide the basis for the good management. Good ore seems sometimes to be quite helpful to good management, and good ore is not as easy to find as it used to be. And there are still more reasons, why—when this honor had been decided upon and named for Mr. Daniel C. Jackling—it should be initially conferred on Reno H. Sales. . The terms of reference of the award are that it should be conferred upon an individual working in the fields of mining, geology, geophysics, who has made an outstanding contribution to the progress of technology in one or more of those fields. And in this initial year (the earlier years are the easiest) just that was done. I think I could get away with it amongst the old-timers of my generation if I say that this time they made the award to the individual, who made the outstanding contribution. But, as Al Smith used to say, "Let's look at the record." Really, the record is mixed up a little with extra-lateral litigation—the old-time "apex cases" under Section 2322 of the Revised Statutes. Reno Sales doesn't like such litigation, but there is little question that the urgency, generated by conflicting claims of intra-limital and extra-lateral rights, and consequent necessity for committing to records and maps the complications of Butte structure, did advance—and by several years—the first continuous, accurate, systematic, and scientific portrayal of the geological and mineralogical details of what is, after all, the most important and the most complicated copper district—at least in North America. Prior to Sales' time, some of the most eminent of geologists often waived details. One geologist took the judge to the window to show him the Rarus fault going through a notch in the Continental Divide. The entertaining testimony in the Bluebird litigation was as perfect in literary style as it was innocent of the criteria by which faulting and lack of continuity of vein structure are now recognized. At any rate, this need for an accurate record of structure was in the background—to whatever extent it was, or was not, the etiological agent—for formation of the Geological Department of the Amalgamated Copper Co. in and about the year 1900. Charles W. Goodale was at that time the head of the Boston & Montana, and John D. Ryan succeeded William Scallon as the president of Anaconda Copper Mining Co. in 1905. Horace V. Winchell, for years a specialist in extra-lateral litigation, was perhaps the man who at that date had the vision, the persuasive weight with the management, and the willingness to defend the idea of large current expenditures (as then viewed) for a complete and sys-

The design and construction of cross-country pipelines for fluids such as crude oil appears relatively simple compared to the complex problems encountered in slurry systems. Considerable effort has been expended in hydraulic research laboratories in an attempt to improve the understanding of slurry behavior. This effort has been rewarded with considerable success and is best illustrated by the large number of slurry systems now planned or under construction. However, slurry transport in pipelines is still, in many instances, more of an art than a science. In order to minimize the risk factors in the construction and operation of large scale slurry systems, studies are frequently conducted in pilot scale test loops such as the one at the Colorado School of Mines Research Institute. The pilot scale projects are designed to provide the basic engineering data necessary to design slurry transport pipeline systems. Usually three slurry solid concentrations are pumped at various line velocities and optimum slurry densities and velocities are determined. Critical velocities, friction head losses, power requirements, and so forth, are also determined from measurements and calculations. Wear tests are also strongly recommended and anticipated pipe wear rates in inches per million tons of solids reported.

An insight into the mechanism of electrocrystallization of copper in simulated commercial acid electrolytes has been surmised from scanning electron microscope analysis of laboratory prepared specimens. The growth takes place in three overlapping stages. In he first, lasting approximately one hour at 200 amps/sq m, a propensity to epitaxial growth is observed. During the second stage a preferred orientation developed. The crystallography of the deposit showed a strong preferred orientation with the [111] direction normal to the surface. Triangular pyramids with (111) faces and (111) texture is a common result. In the third stage, occuring at longer deposition times, side growth, dendrite-like branching is common. The obsermtions have some elements in common with published results for highly purified electrolytes. Several significant differences were observed. The truncated pyramidal and block type growth discussed in he literature is suppressed under the conditions studied. The results are briefly discussed in terms of the screw dislocation, fault, and layer type growth mechanisms of crystal growth.

This district commences near Pigeon River, the northeastern boundary between Minnesota and Province of Ontario, and extends entirely around the north shore of Lake Superior, terminating for the present at the Bruce Mines on Lake Huron. The discoveries of mineral-bearing veins have been confined for the most part to the lake shore, or to the country opened up by the Dawson Red River road. As yet the country back from the lake has been but little explored, on account of its roughness, being intersected by steep, rocky trap bluffs, 1000 or more feet high, and alternating white cedar and tamarack swamps. The forests are exceedingly difficult for prospectors. In many places Titanic piles of rocks, protected by chevaux-de-frise of dead cedars, with their hooked, tough, sharp branches, and a covering of spongy moss, sometimes several feet thick, successively guard against the discovery of hidden treasure. The Hudson's Bay Company for nearly a century have maintained trading-posts at Fort William and other points, which probably opened the way to the first discoveries that were made at Prince's Bay, near the western limit of the district. At this point a large vein was worked by Colonel Prince, the owner, as early as 1846. The richest part of the vein seems to have been on Spar Island, but work was stopped on account of excess of water. Sir William Logan states that a mass of ore weighing several hundred pounds and carrying 3 per cent. of silver was taken out. On the mainland small quantities of native and sulphide of silver were found, together with iron and copper pyrites, zinc blende, and galena, in a large spar vein. Mine, mill, and smelter wastes aggregating billions of tons are scattered across the country as unattractive barren piles that mar the natural beauty of the land. As the population of the United States increases and the demand for land intensifies, populous centers are slowly encroaching on these formerly isolated wastes. Encroachment sharply intensifies the importance of controlling the air and water pollution derived from natural weathering of such wastes. Use or stabilization of these wastes comprises the only viable means for minimizing pollution. Utilization is preferable to stabilization, because full use would both eliminate the waste and broaden the mineral resource base. However, the wastes typically comprise immense tonnages of materials discarded by selective mining or after recovering the significant mineral values by milling and/or smelting. Only rarely can such low-grade material be reprocessed to extract additional minerals at a profit. Some mineral wastes are suitable for disposal as mine fill, railroad and highway road ballast, and land fill. Similarly, some mineral wastes can be utilized as raw materials for making brick, rock wool, concrete, and ceramic products. Several means exist for stabilization of relatively fine-sized wastes, which constitute the chief sources of air and water pollution. These include physical, chemical, and vegetative stabilization, and combinations thereof. Massive coverings of coarse slag, concrete, and soil may be used to prevent erosion of waste piles. A variety of chemicals can be used to bond the particles of fine-size waste into a relatively inert mass. However, the most promising method of producing an esthetically appealing storage site is vegetative stabilization. Numerous species of plants can germinate, grow, and reseed in waste materials which have been adequately prepared to support plant life.

ZrB2 was produced in batches of 4 to 6 Ib by interaction of ZrO2, B4C, B203, and carbon at around 2000°C in a simple graphite resistance furnace. Techniques of production are discussed and the final design of a suitable furnace is described in detail. Several other borides were made by the same technique and the process appears to have possibilities for commercial production. N seeking out new hard and refractory com- pounds, many researchers have turned to the investigation of the borides and excellent papers have been published on the properties of these compounds. Few papers, however, have appeared on the techniques and problems concerned with the production of these high temperature substances. This report describes progress made in developing a method for preparing zirconium diboride, ZrB2, on a pilot plant scale. The literature of the borides and other refractory hard metals recently has been reviewed, annotated, and classified so completely' that it is needless to attempt such an outline here. It is enough to say that three borides of zirconium have been reported: ZrB, ZrB2, and ZrB12.2 ZrB2 is the most stable of these and is especially stable in the presence of carbon up to and including its melting point of around 3000°C. Like most borides, it can be prepared in several ways. It can be prepared by synthesis of the elements, but these are expensive and difficult to produce in a high state of purity. Obviously, production directly from the oxides would have decided economic advantages. In electrolytic production such as that of calcium boride,:' the product is recovered as a sludge mixed with electrolyte; and separation of product from adhering electrolyte and regeneration of the electrolyte is an involved and difficult process. The work on borides was started on a small scale in 1948. Late in 1949, Naval Ordnance expressed a specific interest in ZrB2 and the project then centered on this compound. After the usual experimental work necessary in a new field, ZrB2 of good quality was produced by heating mixtures of B4C, ZrO2, B2O3, and carbon to a temperature of about 2000 °C in a resistance-type electric furnace. Over 100 lb was made for experimental use tests, and the method of production probably could be expanded into a commercial operation. A similar process has been described by Kieffer and coworkers.' The main chemical problems were the development of proper charges to insure complete reduction of the elements, determination of the proper temperature range at which these reductions took place, and adoption of techniques necessary to pre- vent inclusion of such impurities as carbon and nitrides. The mechanical problems consisted of developing a simple practical furnace that would attain the high temperatures required and permit use of a controlled atmosphere when necessary and determining of suitable refractories. Both problems were solved by designing a crucible resistance furnace. Crucible Resistance Electric Furnace Attempts were first made to produce ZrB2 in an electric arc furnace, but such a furnace would not provide the degree of carbon control required for producing clean graphite-free borides, so it was decided to try working in a crucible. Obviously, the furnace would have to be constructed of graphite, as the temperatures required are too high for other refractories or heating elements. Crucibles were made by hollowing out segments of graphite electrodes, which were fitted with a cover and clamped between two electrodes so that the current passing through the thin wall of the crucible would generate heat, using the principle of the Helberger crucible furnace."? Preliminary tests with this type of furnace were encouraging and led to the furnace design shown in Fig. 1. The essential components were a thin-walled graphite crucible resting on a graphite block, which formed the lower electrode assembly, and a top electrode assembly swung from a pipe column making contact with the top of the crucible. The space around the crucible was filled with graphite prepared from waste electrodes crushed to about ¼ in. This packing had excellent insulating properties, both electrically and thermally, and could be removed easily and quickly from around the crucible by means of an industrial vacuum cleaner. The largest resistor crucibles were machined from 8 in. electrode stock and were 26 in. long, with a side wall Yi in. thick and a 1 in. bottom. Temperatures were determined optically by sighting down a 1 in. hole drilled longitudinally through the top electrode and the crucible cover. Sealing this hole at the top was a water-cooled brass sight-glass assembly, shown in Fig. 2. An opening was provided for a light flow of helium to keep the sight opening clear of smoke, and a glass prism above the sight glass changed the line of sight to the horizontal for easier reading. More recently, the prism and optical pyrometer were replaced by a photoelectric recording pyrometer. At first the charges were placed directly in the resistor crucible but this meant that everything had to be withdrawn from the furnace every time the charge was emptied. THE orientations of tetragonal tin crystals are commonly examined by either the transmission Laue method or the back-reflection Laue method. The predominant planes and zone axes of the pattern are plotted on a Wulff net and indexed by measuring the angles between planes and directions. The problem of identifying the Laue spots has been approached in several different ways. Nicholas 1 tabulated interplanar angles for ten planes but did not relate the angles to permutation of indices or sign. A table of angles between adjacent planes and of angles between adjacent zones was published by Chandrasekhar and veal.' These tables are very helpful, provided the film shows all the low-order zones that occur within about 20 deg of each other. Frounfelker and Hirthe's compilation3 of angles between the (001) plane and twenty-nine other planes is useful for the indexing, only if the (001) spot can be found on the film. For all but the simplest orientations, however, more information is needed to index the diffraction spots. Standard stereographic projections, such as those published by Bicelli, 4 provide part of the information required. By their nature, these projections show the positions of only a few zone axes. In the tetragonal system many low-order zone axes are not normal to the planes having the same indices. Consequently, planes and directions can have entirely different positions on a stereographic projection. For example, the [011] zone axis is 33 deg from the normal to the (011) plane. The crystallographic orientation usually has to be deduced from a combination of the predominant zone axes and a few low-order planes that appear on the film. In addition to a standard stereographic projection of the planes, a stereographic projection of the directions is needed. Such a projection can be constructed from the angles given in Table I. To provide more information about angles between planes and directions, we have calculated interplanar angles up to (332) and angles between planes and directions up to [332] on an IBM 1620 computer. The angles are differentiated according to permutations of sign and indices. Those doing research on tin single crystals are welcome to request a copy of these tables from the authors.

THE Cuajone porphyry copper deposit is the northernmost of a group of three deposits in southern Peru controlled by the Southern Peru Copper Corp.-Toquepala, Quelleveco, and Cuajone— all within a 20-mile belt. Although small pockets of high-grade copper oxide ores were worked in the Cuajone area in the 19th century, it was not until 1939 that its potentialities as a disseminated deposit were recognized by 0. C. Schmedeman. An exploratory drilling pro- gram was begun in December 1942 and continued until early 1945. The program was revived in November 1952 and completed early in 1954. Early exploration was by diamond drilling. Later exploration was predominantly churn drilling, with diamond drilling used only for wildcat holes. Along this northwest-trending belt of deposits. which follows the western slopes of the Andean Range, quartz-monzonite has invaded earlier dio-rite intrusives and a series of warped and tilted Cretaceous volcanic flows. Little faulting of consequence has been recognized within the mineralized areas. Sulfide minerals were introduced into all these diverse rocks, and mineralization was followed by erosion, oxidation, and enrichment. In Late Tertiary and/or Quaternary time the entire

Y.-Mr. Tillson's paper on hammer drills is of much interest to me. Early in 1909 I was invited to make tests of our drills at the Franklin mine of the New Jersey Zinc Co. The first drill that we tested gave very poor results. This was a drill having a hammer piston 1¾ in. in diameter and 3 ¼ -in. stroke, the hammer piston weighing about 6 1b., the 1 ¾ in. diameter being exposed to pressure at either end. Although this drill has given excellent results as a sinking drill, its performance as a stoping drill was poor. This was one of the surprises of the limestone as spoken of by Mr. Tillson. This led me to further investigation, and a second drill was developed, with a much lighter piston and a somewhat longer stroke, that gave better results. In the design of this drill, no attention was paid to the cost of construction, our whole attention being given to the increase in drilling speed and reduction of the quantity of air used. The first drill of this type had a piston weighing about 2 ½ lb. and a stroke of 3 ¼ in. The piston was made with a hammer-bar extension, and the cylinder was made with two diameters of the bore, one in which the hammer-bar extension moved and the larger one in which the piston head moved. THE importance, to geologists and metallurgists, of knowing the mineralogical forms in which the silver occurs in ores has increased during the past few years, and will continue to increase as long as working hypotheses are converted into proved theories and rule of thumb methods are supplanted by scientific data. The methods used for the determination of these silver minerals have been: (1) careful study of polished ore sections with the microscope, and more recently, (2) metallurgical separation of the ground ore by flotation, tabling and panning, supplemented by microscopic examination of these separated minerals, and chemical analyses. During the course of some experimental work carried on by the testing department of the International Smelting Co. and myself, it became important to determine, in a general way, the distribution of the silver values in the minerals, as they exist in Tintic Standard and North Lilly siliceous oxidized lead-silver ores. These mines are in the East Tintic Mining District, State of Utah. In this work the second method was used. Differential flotation tests were run, separating the sulfide from the oxidized minerals, and the products were assayed. Various concentrates were carefully panned and the separated products assayed; special samples of ore were selected and assayed. The microscope was used only for the purpose of determin; ing whether the individual minerals were in the so-called "free" state. Analysis of Tintic Ores These chemical and mineralogical determinations showed the silver to be present as native silver, argento jarosite, argentite, and combined or inherent in the tetrahedrite, chalcopyrite, galena, pyrite, cerussite, anglesite, mimetite, malachite, iron oxide and occluded in the quartz. Careful microscopic work would probably show other forms in small amounts, such as the halide silver minerals and some of the antimony sulfide combinations. The tabulation of the analyses of the various products (Table 1) shows no evidences of fixed ratios of silver to any particular base metal.

THE COMMITTEE, appointed early in May, met and organized in Washington, May 9, 1923, and were then advised that such data as they required would as far as obtainable be submitted to them in tabulations, and that they could not be allowed to see the individual reports nor know the identity of the operators on whose reports the figures submitted were based, therefore the Committee's valuation is based on data received from your statisticians, and on tonnages estimated by your staff and by the United States Geological Survey. Various methods of valuation for mining properties have been suggested, but all authorities seem to agree in accepting, as the fairest and most practicable and logical, a capitalization of the estimated future earnings, when such estimate can reasonably be made. Hoover and Finlay both emphasize this. The United States Supreme Court says in Cleveland, Cincinnati, Chicago & St. Louis Railway Co., v. Backus, 154 U. S. 439: But the value of the property results from the use to which it is put and varies with the profitableness of that use, present and prospective, actual and anticipated. There is no pecuniary value outside of that which results from such use. The amount and profitable character of such use determines the value. The Committee on Federal Taxation of the American Institute of Mining and Metallurgical Engineers, appointed in 1919, in its report states: A proper value of a mining property is the present value of the prospective net earnings, taking into account probable variations in output and value. Ingalls (" Wealth and Income of the American People," p. 97) says: The fundamental principle of mine valuation is the present worth of an annual dividend accruing during the period of years corresponding with the life of the mine. It is a convention that the estimated period shall not be more than 30 years.
