Approximately 2000 years ago, the Lord admonished the scribes (lawyers) and pharisees (religious leaders of that time) that they had paid the tithe but had omitted the weightier matters of law, judgment, mercy, and faith. (Matt. 23:23) I want to talk about "The Weightier Matters of Law." In a situation where big government is trying to have an effect on even small details of a work activity, otherwise simple situations become complex. Regulations are written to such detail that constant compliance with strict interpretations can be a nightmare-not to mention off the target of the intended purpose for the regulation. One soon recognizes the onerous characteristics of federal statutes. Another admonition the Lord gave those lawyers and pharisees back then was that they tended to strain at a gnat and swallow a camel! He meant that the pharisees were given to devoting themselves to the strict interpretation of law by writing hundreds of subrules or interpretation to law. In doing so they eventually lost sight of the original purpose of the law. I think they were being told, keep the law-but don't neglect to humanize it Keep it simple Recognize the purpose of why the law. "Mix in" a common sense approach. Someone once said, "Common sense is instinct -enough of it is genius." Today, as 2000 years ago, we need more "genius" displayed by legislators in considering the weightier matters of law. First of all true legislature genius calls for a declarative statement about the purpose of the statute and a fair, objective analysis of the ground rules by which it will be implemented. In the Health & Safety Act of 1969, the "findings and purpose" as set forth in Section 2 do define its purpose. I believe most of us affected can be in accord with the reasons advanced for the legislation. However, beyond those well-intentioned few paragraphs, we very quickly run into trouble. Congress complicated the simplicity of the statement of purpose by mandating government intervention into areas that cannot be effectively legislated, nor even should be legislated. The Act provided for broad gaged regulation which is unnecessary, inappropriate, and tremendously costly. Frankly, it detracts from a constructive, cooperative effort by the parties involved. These are strong negatives which characterize inappropriate legislation. Appropriate legislation and subsequent regulation, which is realistically conceived and practically enforced must be born of an honest desire for improvement, based on a working knowledge of common problems which are thoughtfully analyzed. Then the legislation must be written in clear concise language so that there can be little or no doubt as to its literal meaning and intent. To be practically enforced, it must be understood by all who will enforce it and by all who are subject to it. That is to say, an effective law or standard cannot be fixed or inflexible so that it cannot be tempered in human judgment. There must be an elasticity in the statute to provide for consideration of all of the relevant facts of a given situation. Such elasticity makes the compliance effort as meaningful as it can be for the time and dollars invested. Meaningful compliance requires room for common sense. Today, we in business along with our associates in government and labor, urgently need to pause, and assess our current situation. The problems arising from the 1969 Act have been intensified through the Mine Safety & Health Act of 1977. After reading the "findings and purpose" of this legislation, and by process of elimination, we should all clearly see what is and is not the purpose of the Act. 1) It is not to turn the management of private industry over to government. 2) It is not to impair the efficient operation of business. 3) It is not to reduce productivity and profits. 4) It is not to reduce national unemployment. 5) It is not to perpetuate the bureaucracy. 6) It is not to increase the tax burden on an already overburdened people. 7) It is not to increase our balance of payments deficit. 9) It is not to replace management/labor relations in working together to solve problems.

The Occupational Safety and Health Act of 1970, although providing no precise definitions of safe and healthful working conditions, specifies mandatory duties, and methods and procedures -- "to assure so far as possible every working man and woman in the nation safe and healthful working conditions." The dynamics of the workplace ad the dynamics of this coextensive Act both spring from the same source. Both require at any given time an application of the then con- temporaneous highest state of the art. Both are flexible, ongoing, adaptive, changing; both advance by a blending of experience and research.

I chose the title "Let's Clear the Air" for this afternoon's presentation because it has two meanings, the literal and the figurative. Most of you know what MSHA is. Most of you know what MSHA does. And, for the most part, most of you know why. What I hope to accomplish today is to "clear the air" around our health standards, to clarify for you how MSHA views its congressional mandate under Title I Section 101(a)(6), (7), and (9) of the Mine Safety and Health Act. Asbestos, silica, radiation, noise, welding fumes, carbon monoxide, lead, hydrogen sulfide, nitrogen dioxide - the list of physical and chemical hazards encountered in the metal and nonmetal mining industry is as diversified as the industry itself, possibly even more so. In addition, miners are often exposed to several of these health hazards simultaneously.

The public relations problems of users of explosives have greatly increased within the past few years. One reason is that explosives and blasting agents are being consumed in increasing quantities. The principal reason, however, is that more people have become physically affected by blasting. Mines, quarries, and construction sites that were formerly in relatively remote locations now find themselves near congested areas. New express traffic ways being constructed to connect the suburbs with downtown areas are being built through the middle of long-established business and residential neighborhoods. The public becomes aware of blasting by two physical sensations-vibration and noise. Vibrations are usually so slight as to be negligible, and in most cases the only sensation noted is noise. The reduction of vibrations to this low level has been primarily achieved by the use of blasting practices and explosive products recommended by vibration engineers based on seismograph recordings. Unfortunately, very little scientific attention was given to the accompanying physical sensation-noise.

Bateman Engineering managed the establishment of a second diamond treatment plant at the Letseng Mine in the Mokhotlong District of northern Lesotho, about 100 km from the town of Buthe Buthe. Letseng Diamonds Proprietary Limited, is owned 70 % by Gem Diamonds and 30 % by the Government of the Kingdom of Lesotho. The second plant, which commenced construction in late 2006, doubled Letseng Mines' hard rock processing capacity from 2.6 million t/yr to 5.2 million t/yr, making it the worlds' seventh largest diamond mine by throughput. Bateman Engineering provided the engineering design, procurement and construction management of the new plant.

Your article on page 202 of the August 1993 Journal refers. I was surprised to read that this grant was first introduced in 1984 as it was awarded to me (albeit under the auspices of The Institution of Mining and Metallurgy, London) as long ago as 1964, and I spent two very profitable months in Sweden at that time. Training in job-skills * A South African mine is leading the way in providing alternative job-skills to staff in a bid to upgrade services in local communities and create greater economic empowerment. In recent months, 85 employees of the Associated Manganese Mine (ASSMANG) in the Western Cape have learnt skills as diverse as candlemaking, shoemaking, concrete-product manufacturing, and brick production through a newly established community training centre.

Mr Janisch' s comment' in the August issue on Dick Stacey's remarks about safety factors indeed requires wider debate. The example he quoted to illustrate the successful application of the safety factor concept in coal mining, namely the Salamon formula, is to my knowledge the only recognized application of that concept. Not only that, but that particular formula should be used only for what it was intended, namely to prevent major disasters. It was never intended to indicate long-term pillar stability, and it should not be used for that.

Brigadier R. S. G. Stokes of Sherborne, Dorset, is the oldest surviving member of the South African Institute of Mining and Metallurgy. He joined in 1904 and has been a member for 77 years. Batcheller, we are able to give the following extracts from a letter written by Mr. Caetani: It has been a nice idea of yours to collect for me all those scraps of news I received a few days ago and to send me such a long interesting letter. In four years war I have had practically no news. Burch wrote several times but several of his letters were lost and so mine. I believe I even wrote to you. Much has changed since our last days in Telluride; here and there many have disappeared. Of myself I will tell you in a few words: for a year I was in Cadore(?), where I had the good luck to do to the others what they wished to do to me, and had good luck on my side. Then I went to Macedonia for 5 months, did little fighting but lost my faithful fellow officer and companion.

I can think of no better candidate than Daniel that is deserving of this award ? an award to recognize technical excellence in advancing ground control technologies [and] approaches. Daniel?s education and career spans over three decades. Having graduated from National Cheng Kung University in Taiwan in 1972 with a B.S. degree in Mining and Petroleum Engineering, he spent the next four years in the Taiwanese military and mining industry, before moving to the United States, where he enrolled in West Virginia University?s Mining Engineering Department. He received his M.S degree in Mining Engineering from WVU in 1978; then in 1982 became the first person to ever receive a Ph.D. in Mining from WVU. His thesis was titled, ?Development of Ultrasonic Techniques for the Measurement of In Situ Stresses?.

Dr. Christopher Mark serves as Team Leader of the Rock Mechanics Section in the Rock Safety Engineering Branch of the NIOSH - Pittsburgh Research Laboratory. In this position he leads a multi-disciplinary team and conducts individual research directed towards fundamental ground control safety issues affecting miners. Dr. Mark is recognized as one of the country?s leading authorities on coal mine ground control. Through his research, he has made numerous important contributions to mine safety that have been widely adopted into mining practice. He is a highly original researcher, and has often developed new and innovative methods to tackle extremely complex problems in his field. In recent years Dr. Mark has also achieved wide international recognition. Five research projects in Canada, Australia, and South Africa have been based largely on his work.

I take pleasure in transmitting herewith "Petroleum Development and Technology in 1927," in which we have attempted to set out in a series of 40 papers with attendant discussions the advances made in Production Engineering and Refinery Engineering during the year. The volume also contains a digest of round table discussions on Petroleum Engineering Research problems and Petroleum Engineering Education. In addition to the above we set out in 16 papers a review of production of each producing area of the United States and of the more important foreign countries, together with a review of the world's production and forecasts for 1928. We also include 8 papers on the Economics of the oil industry. The papers and discussions included herein represent the contributions of more than 200 engineers, including the foremost in each line. These papers were presented at technical sessions held in Fort Worth in October, 1927, and at the annual meeting in New York in February, 1928. We desire to express our thanks and appreciation to all those who have contributed to this volume. As in previous years, we have attempted to emphasize the value of both written and impromptu discussions. -We have made a practice of returning all impromptu discussions to the authors for correction and amplification, and because of this practice we feel that the discussions contained herein are in very presentable and readable form. It was decided by the nominat,ing committee when meeting for thc purpose of nominating officers for 1928 to eliminate the vice-chairrnanship for Transportation Engineering, as that branch of the industry seemed to come more naturally under the activities of the American Petroleum Institute. It was also decided by this committee to institute a new vice-chairmanship for Petroleum Engineering Research. Wc have had heretofore round table discussions on engineering research, but through the newly created vice-chairmanship, to which Mr. L. C. Uren was elected, we expect to have more comprehensive sessions on engineering research than heretofort.

INTRODUCTION In the mining industry, timing in land acquisitions can be of the essence. In order to secure promising lands, deals are often negoti- ated quickly and evidenced by letters of intent containing what the parties feel are the essential terms of the deal. In some cases, a company is willing to acquire land only if it can lock up a number of promising properties, and so a "non-binding" letter of intent is used to formalize the essential terms, while leaving the company without legal liability. Later, the letters of intent will be sent to a lawyer to prepare a formal acquisition agreement. Many times, how- ever, especially in a land acquisition rush, another company will attempt to better the deal prior to the execution of that formal agreement, and the first company will be forced to rely on the initial letter of intent, only to find out to its chagrin that it has no deal In other cases, the company holding the desired property is another mining company, and the negotiation of an option or joint venture is the only way the first company can acquire an interest in the desired land. In order to make its offer more attractive, it may have to reveal confidential or proprietary information about the property or the surrounding lands. Here, too, letters of intent are often used to formalize the essential points of the agreement. Once again, however, prior to the execution of a formal joint venture agreement, the transaction may collapse and the letter of intent prove to be only that. I am much pleased by your presentation of my article and flattered to the extent that the cover design refers to it. Incidentally, as between folks who like to work with words, refer to line 6, second full paragraph, page 773 (August Mining Engineering) Would "for" preceding technological have changed the percentages in lines two and three of the bold-face heading on page 770? The intent was coequality among three, (studies of mankind, of science, and of technological empirics). Thirty-three pct for "man" studies is a pretty big bite for engineering schoolmen; 50 pct they won't even examine, let alone nibble at. Arthur F. Taggart For those of you without a copy of the August issue handy, the sentence referred to read: The plea herein is to make the overall time allotment for studies of mankind coequal with those, for science and technological empirics.... For the past several years the policy of a large section of our mining industry in relation to our present bureaucratic form of government has become increasingly amusing, if not a little disgusting. In the past, mining men have always featured themselves the self-announced champions of free enterprise, and, generally, this conviction, was substantiated by their deeds. In recent years, however, a large group of the industry, while still expounding, from the front porch, the principles of free enterprise and a sound economy based upon the law of supply and demand, have gone around to the back door with palm extended, to join labor, farmers, bureaucrats, and other pressure groups to get their share of the take. The procurement of subsidies, bonuses, increased metal prices, and government assistance in a multitude of forms seems to have obscured from their thinking the welfare of the country as a whole and the sounder economic principles of a balanced budget and lower taxes. At the recent Colorado Mining Association convention in Denver, I. was alarmed to see just how far this specialinterest type of thinking has progressed within the mining industry. Government assistance to mining. was generally considered inadequate, and a flat bonus for any new mineral discovery was proposed. It was disquieting, too, to learn how far the federal alphabet agencies have entered into the mining industry and of the thousands of highly paid technical. men on the federal payroll required to man these numerous overlapping agencies and bureaus. Now all this is very fine, and some aspects of the federal give-away program can be very appealing to the unsuspecting in the mining industry as they have been to those in other groups. Some of these expensive programs may bring about a few dividends or even several new mines. But to this whole line of pump-priming reasoning there is one big disastrous fallacy.

My bets are on you, every time! But who is right? In the "cobalt issue" of our favorite magazine, January 1951, you stated: "By far the best immediate United States prospect for, large amounts of cobalt is the Blackbird mine of the Calera Mining Co., which is operating for Howe Sound Co., in Leinhi County, Idaho." In the March 1 issue of Saturday Evening Post, Ernest F. Mechlin, Jr., chief cobalt section, National Production Authority, states: "The Bethlehem Steel Co.'s Cornwall, Pa. ore bed is the principal domestic source." Maybe he should have said: "was the principal domestic source", or perhaps Howe Sound's Idaho cobalt is still in the prospect stage in Mr. Mechlin's opinion, perhaps in yours too. KATHARINE W. The engineering personnel shortage, present and impending, so well brought out in the article in Mining Engineering in the August, 1951 number, both in the editorial lead and the article by William B. Plank and Henry J. Petrie, has left untapped and has ignored a potential source of supply that would fill the need ably and with complete satisfaction. This source is comprised of the women engineers- and geologists, both presently, trained and able to handle work at all levels, and the many who would make splendid engineers and geologists if they could hope for even a modest taste of the square deal that should be theirs, but, as we all know, is not. I write from experience. It is not pleasant or sensible to have to urge borderline cases among men students to consider engineering and geology as careers to fill the need, when I have far more able, interested and suited young women students whom I must divert into other channels. It does not make sense to scrape the bottom and sides of the barrel to induce potentially second or third rate male engineers and geologists to enter the profession when we have superior material among the women, eager to do good work in these fields. It does not make sense for these men to become second or third rate in these fields when they might be first rate salesmen, musicians, advertising copywriters or policemen. Nor does it make any more sense to force potentially first rate female geologists and engineers to become second or third rate and very frustrated typists, kindergarten teachers, dress sales-women or clerks. At this point I am willing to admit that where superstitious -miners object to women in underground workings, men are available for the jobs. Moreover, it is not necessary for women to be sent into the most difficult country, if there is reluctance on either side of the contract. There may be fewer of them eager for the roughest assignments, in proportion to the men, but women are so accustomed to discrimination far more complete than that against any racial or religious group, that a reasonably tough assignment would seem like a heaven-descended joy. In my own experience, I have found that my girl students majoring in geology, could keep up with me in the field in the roughest terrain, but. the men, all but the best students and the most physically fit young men, complained that they could not keep up with me and that I always "walked their-legs off. The women, a few men and I always returned with bags heavy with well chosen specimens and proper notes. Most of the men carried no specimens and-but poor scraps of notes on loose bits of paper. Yet the men were urged to prepare for a career in engineering or geology if their examination marks were reasonably good. When we find that we still have a shortage of engineers and geologists, after putting all the qualified women to work, then we may begin to worry.
