"IntroductionON THE LAST DAY of December, 1951, a half-century of steel production was completed in the open hearth department of Dominion Iron & Steel, Limited, in Sydney, Nova Scotia.During that period, almost every known variation of basic steel making practice was used in working out a steel making process which would overcome the difficult metallurgical problems imposed by the use of Cape Breton coal and Wabana ore.This paper is presented as a brief review of these steel making practices, setting forth the fundamental metallurgical factors involved in their success or failure.Establishing the IndustryThe story of steel production at Sydney is closely interwoven with that of coal. The steel industry owes its inception to a desire on the part of the Dominion Coal Company, which was incorporated in 1893, to improve its marketing position by increasing sales of slack coal and providing a year-round demand for its product. Accordingly, the Dominion Iron and Steel Company, Limited, was incorporated on March 30th, 1899, with Mr. H. M. Whitney -who was President of the Dominion Coal Company -as its first President. The new Company was given powers to manufacture and process iron and steel, and to mine all minerals, including coal.A strong inducement to the industry was the bounty offered by the Dominion Government for the production of both iron and steel."

Members of the Society of Mining Engineers may well regard it as rather unusual that a paper on this subject is being presented by someone whose first taste of mining came at the age of 60 or so - someone who last heard of cathodes and anodes in 1938. On the other hand, the title does refer to the financing of a mine and at least I can claim to have spent all my business life since the war until 1981 in the world of banking, though this inevitably means that I have been used to looking at these and other problems through what you might regard as the wrong end of the telescope. The lending of money, and more particularly the provision of finance for commerce and industry, is the central job of a banker and I have been involved in this in various ways over many years, but regrettably only very marginally in the world of mining. As you will see from what follows, the rather specialised form of finance which RTZ required was, to my regret, not provided by the British banking community since the great majority of the finance came from American banks and, to a lesser extent, from German banks. I am most indebted to Mr. Roy Wright for a great deal of the nuts and bolts in this paper. He was one of the three central figures in the growth and expansion of RTZ during the 1950's and 1960's and was right at the centre of the negotiations with bankers, with governments and with many others. The going, as you will see, was far from easy. The essential basis for the financing of each of the RTZ group's mining projects was a firm long-term sales contract for sufficient of the output of the particular mine to produce the cash flow necessary to service the loans. Wherever possible, loans were raised in the same currency as the sales contracts were made. Each sales contract was designed to give the customer the product he wanted with a long-term assurance of supply and at the same time to give the bankers the protection they required. Thus the marketing concept and the financing concept for a particular mine formed one overall plan, and talks with the customers and the bankers were conducted in parallel until a satisfactory marketing/financial package was agreed in principle. Preliminary talks were begun soon after the discovery of a potentially viable orebody. As confidence about a discovery increased, customers were persuaded to enter into contingent sales contracts before the very detailed and costly business of the economic and technical feasibility study of the mine was launched; such a study might cost 10% or more of the estimated total capital cost. At the same time provisional understandings were reached with the bankers. The contingent sales contracts usually gave a period of grace of eighteen months to two years, during which time the decision whether or not to continue with the mine had to be made. This decision rested mainly on the result of the feasibility study and also on coming to a firm agreement with the bankers. If all went well and the mine went ahead, then the contingent sales contracts became firm, but they fell away if the decision was negative. The Company was fortunate that during the whole period when its major mines were being developed, world trade was increasing rapidly and Japan was becoming a dominant industrial power. The Japanese supported many of the mines, including Hamersley Iron Ore, Lornex Copper, Bougainville Copper to name a few, with the basic long-term sales contracts that enabled their development. The Germans supported Palabora and to a lesser extent Bougainville. The mines were financed as individual projects generally with a loan/equity ratio of about 65/35, without legal recourse to RTZ for the loans. RTZ was, however, responsible for providing any capital overruns required to bring the mines into commercial operations. Nevertheless, the RTZ management regarded itself as morally responsible to the lenders because, Palabora aside, the sales contracts had either a fixed selling price (like Hamersley), an indexed price (like the Elliot Lake Uranium Mines and Mary Kathleen), or a floor price (as in Lornex, Bougainville and Rossing). "This paper provides a bird's eye view of the pattern of gold discoveries since 1823, the year of Canada's first gold find, up to 1983. Within this 160-year period, more gold was discovered in Canada during the last ten-year period (1973-1982) than during any previous decade. The record suggests that the potential for further major gold discoveries is high, which bodes welt f or the future of Canadian gold mining.IntroductionCanada has an impressive history as a gold producer. Since 1921 we have occupied second or third place among the world 's gold producing nations, after South Africa and most of the time the U.S.S.R. Canadian gold production over the last hundred years has added up to some 6 per cent of all-time world production.The sharp rise in the price of gold in the 1970s led to a surge of gold exploration, which in turn resulted in the discovery of significant quantities of gold in Canada. How do these recent discoveries rate in comparison with those of the more distant past? For example, are the quantities of gold in notable discoveries of recent year s, such as Hemlo and Detour, in the same league with the amounts of gold discovered around 1910 in the Porcupine and Kirkland Lake district s of Ontario? Can the combined gold content of the recent discoveries be likened to that o f the almost 40 major Canadian gold deposits, along with numerous smaller ones, discovered in Canada during the 1920s and 1930s? What are the implications of the more recent gold discovery record for future rate s of gold discovery in Canada?This paper attempts to glean answers to such questions from an overview of the period that begins in 1823, the year of Canada's first gold discovery. Gold deposits come in two major types: placer deposits and lode deposits in solid rock . Placer gold is distributed in sand and gravel. Gold in solid rock occur s mostly in gold ore filling fissures."

The history of Ore Reserve classification and reporting in Australia is largely a history of the Australian mining industry itself. In the late 1800s, when the industry was dominated by small scale, high grade underground mines, Reserves (if estimated) were based on hand sampling and geological inference, and reporting of Reserves was either non-existent or of extremely variable quality. By the mid-20th century, the industry was dominated by large underground base metal and gold mines. Reserve estimation was coming under the control of skilled geologists and mining engineers, however Reserve classification and reporting standards continued to vary in type and quality from mine to mine. Today, large scale, low grade mining operations predominate, and Reserve estimates are generally based on extensive drilling results processed (with geological control) by computer. Through the efforts of a Joint Committee established by The Australasian Institute of Mining and Metallurgy and Australian Mining Industry Council, Reserve and Resource classification and public reporting has been standardised and controlled by adoption of the ""Australasian Code for the Reporting of Identified Mineral Resources and Ore Reserves"" released in 1989. The Code, which will continue to be modified and improved by the Joint Committee, has also been used as a basis for guides to reporting in other countries, and there is now some hope that this difficult and vexing topic may finally become subject to international standards and controls.

During the last decade, MHO has continued to diversify the feed. of its Hoboken smelter. The range of feed materials including larger proportions of precious metals has been extended and the production of minor metals has been developed. These diversifications have required further improvements at the smelter. Attention has been particularly focussed on an increase of productivity, compliance with emission standards and achievement of the highest recoveries of valuable elements. The assaying and sampling facilities have been considerably expanded and the different processing steps of the smelter are now also systematically controlled and managed by simulation models. The charge preparation at the sinter plant, returns handling, sinter conditioning and corresponding ventilation systems have been completely renewed. The annual smelting requirement is now achieved with two blast furnaces instead of three. This is the result of rebuilding and enlarging one of the furnaces and, of a completely new concept of the charge proportioning and charging systems, together with oxygen enrichment and blast air preheat. Ventilation capacity has also been drastically increased. A 7 MVA electric furnace for cleaning the slag from both blast furnaces. contributes to improving the overall metal recovery.

THIS shaft, located in the northern anthracite coal-field about 2300 feet southwest from the court-house at Wilkes-Barre, in the County of Luzerne, Pa., is the property of the Lehigh & Wilkes¬Barre Coal Company. The sinking and cribbing to the solid rock (see isometrical view on Plate IX) was conducted by Mr. W. W. Kenrick. Dimensions of the earthwork to the foundation of the cribbing, 51' 1/2" long, 17' 4" wide, 31' deep. Total amount of excavation in cubic yards, 998.5. Dimensions within the permanent cribbing, 45' 4" long, 11' 16" wide, 31' deep, divided into six parts by buttons 8" x 12", each division, 7' x 11’ 16". Permanent cribbing 12" x 12"; temporary cribbing 8" x 10"; backing, 3" thick ; clay puddle to ex¬clude surface water, 12" thick; conductors, 8" x 5"; lining, 1" thick from top to bottom of the shaft. In the latter part of the year 1871, Mr. H. Murray & Son contracted with the company for the continuation of the work at the rate of four hundred dollars per yard in depth, to a point 100 feet below the Hillman seam of coal ; for the succeeding 100 feet the price to be increased twenty-five dollars per yard, and so on until the bottom rock of the Baltimore seam of coal was found. The size of the shaft within the cribbing timbers is 45 feet 4 inches by 11 feet 6 inches, having six divisions of equal dimensions, 7 feet by 11 feet 6 inches, giving room for what is known as the" standard diamond" car, whose capacity when level full is 100 cubic feet, but when loaded by the miner 4 inches above the top contains 112 cubic feet.* Two divisions of this shaft are intended for hoisting coal from the Hillman seam, two from the Baltimore seam, one for ventilation, and one for pumps. The works were planned for two pairs of direct-acting, high-pres¬sure engines, twenty-four boilers, and for an estimated output of 2500 tons of coal per day from the two seams. * Size of the "standard diamond" car, 8' 10” x 4' 3" x 2’ 8” = 100.1.4; loaded 4 inches above the top, 8' 10” x 4’ 3” x 3’ “0"= 112.7.6.

The accumulation of damage due to localized corrosion [pitting, stress corrosion cracking (SCC), corrosion fatigue (CF), crevice corrosion (CC), and erosion-corrosion (EC)] in complex industrial systems, such as power plants, refineries, desalination systems, etc., poses a threat to continued safe and economic operation, primarily because of the sudden, catastrophic nature of the resulting failures. Of particular interest in managing these forms of damage is the development of robust algorithms that can be used to predict the integrated damage as a function of time and as a function of the operating conditions of the system. Because complex systems of the same design rapidly become unique, due to differences in operating histories, and because failures are rare events, there is generally insufficient data on any given system to derive reliable empirical models that capture the impact of all (or even some) of the important independent variables. Accordingly, empirical models have generally failed to provide a robust basis for predicting the accumulation of corrosion damage in complex systems under realistic operating conditions. The alternative prediction philosophy is determinism, in which the development of damage is described in terms of valid, physico-electrochemical mechanisms with the output being constrained by the natural laws. The differential damage is then integrated along the corrosion evolutionary path for the system (i.e., over the future operating "history") to yield the desired integrated damage, which is the quantity that is most useful to an operator. In this paper, we review the theory of predicting corrosion damage within the framework of Damage Function Analysis (DFA), with particular emphasis on the pitting of aluminum in chloride solutions and on the accumulation of damage from SCC in Type 304 SS components in the primary coolant circuits of Boiling Water (Nuclear) Reactors (BWRs). These cases have been selected to illustrate the various phases through which localized corrosion damage occurs.

I HAVE been asked to pay a tribute to the mining industry. It is appropriate to this occasion that a word upon this subject should be spoken to this assemblage; but to pay a tribute to the mining indus-try, one that would be worthy of its traditions and its accomplishment and that would outline what it has meant to the economic and social development of this nation, would carry me far beyond what must be the brief confines of this address. I wonder how many there are who have ever paused to reflect how different might have been the current history of the world had it not been that for nearly eighty years a never-interrupted stream of wealth has flowed from the storehouse of treasure in the mines of the West into the commercial and economic life not only of this nation but of the world. Truly it was a historic day that Marshall discovered in the runway at Sutter's mill the glistening particles that proved to be gold. That event was one of the most momentous events in its consequences that ever happened in the history of mankind. Without its occurrence this nation undoubtedly would have grown; it would have reached a position; of economic and social soundness; but certainly it could not have achieved the splendid and immediate results that have become our proudest heritage and established our unrivaled posi-tion in the industrial world. As the primal cause that led to one of the great migratory movements of man it stands alone, unequaled, without any precedent in the annals of history, comparable in its effect on the imagination, on the movement, and on the devlop-ment of a people. Nearly three-quarters of a century had passed since the banners of the Revolution had been furled and a new nation had come into existence. Beyond the boun-daries of the original colonies, and through the passes of the Alleghanies, hardy frontiersmen had cut their way, and the process of establishing what have become -great states in the Valley of the Mississippi was under way. An empire of virgin land beckoned to the home-seekers of the world; but scarcely had its occupation been begun when, true to the instinctive urge that meant the ultimate destiny of the nation, there began the movement to carry the Stars and Stripes westward to the Pacific. Within the boundaries of what was then Mexico, Americans fought and died in the Alamo, and the banner of the Texan had been raised in eager ex-pectancy that its Lone Star might be added to the grow-ing constellation on the American banner.

Over the past 25 years hard-rock mining companies have developed a number of profitable computer applications which appear applicable to operations in the coal industry. The evolution of these applications are described and the most profitable discussed. The basic nature of these systems is that they must cut across organizational boundaries. While technological advances contributed significantly to the successful implementation of computers within mining, the human aspects related to organization, management and control of systems projects remain as key to future success in coal as they were and still are in hard-rock mining.

"Money and reputations can be lost in bad projects. Causes of bad mineral processing projects include poor contract definition and purchase of equipment without adequate test work. However, the root cause of many of the problems that can lead to bad projects is not any inanimate object, bad weather or catastrophic natural event but the people working on the projects. Because the people are so critical to the success of a mineral processing project, one must have suitably qualified and experienced people (SQEP) in all key positions. Characteristics that define SQEP include people who have successfully executed projects of similar size before; have undertaken projects treating the same minerals and producing the same valuable products and people who are familiar with designing, operating and implementing the required technologies and unit operations.To minimize the likelihood of future bad mineral processing projects, five recommendations are put forward in relation to the people aspect of a project.1. Attempt to retain SQEP during any down turn in the mining economic cycle so thatthe knowledge and experience can be kept within the industry.2. Increase the effort in attracting young people into the industry and retaining them.3. Set up robust training program to give young professionals a firm foundation of what real life projects and operations are like.4. Provide mentoring and continuous training for people after they have completed their formal graduate training program. Their career progression should be appropriately monitored and controlled.5. People working in projects must be exposed to as many detailed design and other finer issues as possible so that they can comprehend the amount of work required to deliver a project successfully."

We live in a world of change and the mining industry is enjoying some of the most rapid changes today that have been seen in a long time, We'd like you to open your mind to a new concept in material handling. Figure # 1 Shows a new concept combining some of the proven application advantages of the power shovel with which we are all familiar, and applies the advantages of the dragline for the benefit of the user. First, the hydraulic excavator enjoys tooth forces of the shovel because the dipper is attached to the machine with a dipperstick and boom, and can often actually realize greater tooth forces than a shovel because of the prize action of the dipper in hard digging. Second, the hydraulic excavator enjoys the application advantage of the dragline because both the operator and the machine are up above, sitting on top where the operator oversees the excavation and the machine's operating work range is greatly increased.

Location THE hydro-electric plant of the Peninsular Power Co., is located at what is commonly known as Lower Twin Falls on the Menominee River. This location is about 33 miles north of the city of Iron Mountain, Mich. The principal points of delivery of electric energy from this plant are in the mining regions adjacent to Florence, Wis., and Iron River, Mich., and in the cities of Iron River and Iron Mountain. The hydro-electric plant at Twin Falls and the substation of the Iron Mountain Electric Light & Power Co. are connected by a 6,600-volt transmission line carried on steel towers and steel poles, the latter being used within the city limits. The plant at Twin Falls and the substation at Iron River, about 36 miles distant, are connected by a 66,000-volt, duplicate, three-phase transmission line, supported on steel towers. At Iron River, are located a 1,500-kw. auxiliary steam plant, and the substation, from which the current is distributed to the mines in this vicinity. A description of the auxiliary plant, main and customers' substations, and of the main and secondary transmission lines, follows later in this paper.

WET processes for the extraction of copper from its ores have of late attracted much attention, especially in Europe, where the use of oupriferous iron-pyrites as a' source of sulphur prevails. These processes present an additional interest, when, as is often the case, the copper-ore's to be treated contain one or both of the precious metals, since the complete separation of these from copper, either in the dry or the moist way, is, as is well known, one of the difficult problems of metallurgy. The principal wet processes hitherto in use for the extraction of copper from its ores, may be included under three classes : I. Those in which the copper in snlphuretted ores is rendered soluble in water by calcining them, after a preliminary roasting which removes the greater part of their sulphur, with a portion of common salt, by which the copper is converted into a chloride (Long-maid and Henderson), or with sulphate of soda, by which sulphate of copper is formed (Monnier). Allied to these is the method by which a portion of the copper is got as soluble sulphate by roasting without addition, a process which is sometimes modified and rendered more complete by re-roasting the lixiviated residues with the addition of a portion of raw sulphuretted ore (Bankart). II. Those methods in which free chlorhydric or sulphuric acid is used to dissolve the copper- from oxidized or roasted ores. These, while simple and efficient, are too costly, except in certain localities where chlorhydric acid is a waste product. Related to them is the plan which consists in exposing the oxidized and moistened ores to the slow action of sulphurous acid mixed with air, by which a soluble sulphate of copper is formed. It has been proposed to decompose the solutions of sulphate or chloride of copper by sulphuretted hydrogen, thus separating the copper as sulphide, and using the liberated acid to dissolve fresh portions of oxidized copper. It is, however, the almost universal practice to throw down the copper from its solutions, however obtained, in the metallic state by the use of iron, either scrap-iron or iron-sponge; although in some instances

Introduction Thermal methods have been predominant in the metallurgy of the base-metals ever since the foundation of the industry thousands of years ago. Development in hydrometallurgy has been confined largely to the past six or seven decades. It was at first necessarily slow, then for a number of years rapid progress was made. At present, the uncertain state of the metal industry has curtailed research on the subject; however, in the next few years one may assuredly look forward to an ever increasing use of wet processes. Leaching methods have attained the dominant position in the case of certain metals, notably zinc. For others, they have made no headway at all. Copper presents a situation all its own. Due to the varied nature of its ores and to the large number of localities in which it is mined, a great number of processes have been developed, each suitable in its own particular field. In the case of this metal, therefore, it is more difficult to arrive at definite conclusions. It is the purpose of this paper, first, to review the outstanding developments of base-metal hydrometallurgy, and, secondly, to consider possible Canadian applications of some of the processes in use. The discussion will be confined to the three metals, zinc, lead, and copper, with particular reference to the last mentioned. Zinc General Note At present, zinc is produced by two principal processes, the older retort process and the electrolytic process. The latter is a development of the last twenty years and, judging by its present progress, bids fair eventually to supplant older methods in a large proportion of cases. It is certain, at least, that in the erection of a new plant, a hydrometallurgical process would be given the most serious consideration

[NOTE.-This paper was presented at the Pittsburgh meeting in a partially completed form, and I fully expected to obtain, before the period of its publication, both the data and the leisure required for its completion. The hygiene of collieries was to have been separately considered, and the sanitary conditions of various metallurgical industries connected with mining were to receive an extended discussion, while at the same time the points treated in the paper as presented at Pittsburgh were to have more ample illustration from American and European sources. Delay in obtaining expected information, and the continuous pressure of professional work, have prevented hitherto the execution of this plan ; and I can now publish only a portion of what I had designed to contribute to the subject. In the meantime this portion, but slightly changed, has been included as a chapter on the Hygiene of Metal Mines in a work entitled Hygiene and Public Health, edited by Dr. A. H. Buck, of New York. An excellent chapter on the Hygiene of Coal Mines, contributed to the same work by Mr. Henry C. Sheafer, of Pottsville, affords me an opportunity to supply one of the deficiencies above alluded to. Mr. Sheafer's chapter contains much material in the way of explanations not required by professional readers; and he moreover devotes a considerable space to the explosive gases, falls of roof, and other causes of accidents to life or limb-a branch of the subject not belonging strictly to hygiene. I therefore make extracts only from his treatise.-R. W. R] IT is convenient to divide mines, with reference to this subject, into two classes, collieries and metal-mines. Waste waters from mine sites may be screened for all constituents of significance as a first step in establishing water quality criteria for protection of aquatic ecosystems. Inductively-coupled plasma mass spectrometry (ICP-MS) offers the capability to screen water samples and digest solutions for virtually all elements in the periodic table. This technique is therefore able to identify elements whose concentrations are elevated in waste waters and may be rarely present in background surface or ground waters. Such elements may be present in waters at only a few ¦g/L. ICP-MS has sufficient sensitivity to detect sub-¦g/L or even ng/L levels of many elements. Waste waters from most mining activities in the Northern Territory have been examined by ICP-MS. The concentration data provide the basis of a contaminant data base. The data can show specific tracers in the ore or mineral itself, subsequently found in waste water. An example is the presence of rhenium in uranium ore. Such trace elements may be present in soluble or insoluble chemical forms and are more useful as indicators when soluble and exemplifying conservative chemical behaviour. The approach described, based on ICP-MS screening of mine site waste waters, together with general physico-chemical variables, provides the most comprehensive means yet available of selecting variables for monitoring programs and ensures that key elements and/or their chemical species are not excluded from monitoring programs.

The southern portion of the Swan Coastal Plain, a geomorphological element formed since late Tertiary times, contains commercially exploitable accumulations of ilmenite, zircon, rutile and monazite associated with a series of raised shorelines. The location of the deposits is controlled by a locally outcropping Archaen granite/ granulite complex and a sea current pattern determined by local geography and a prevailing wind direction. A progression from medium to high titanium ilmenite is evident parallelled by progressive leucoxenisation as the age of the deposits increases. Variations in trace element content accompany this process. Circulating groundwater has caused vertical mineralogical variations within individual deposits and by precipitation of iron has formed layers of hardpan.The Geographe Bay deposits are of important economic significance.INTRODUCTIONObservations made during the course of a brief survey of the southern portion of the Swan Coastal Plain provide an outline of the geology and mineralogy of the mineral sand deposits of the area. This preliminary study will require considerable modification in the light of more detailed work in the future.REGIONAL GEOLOGYThe Geographe Bay area is situated in the south-west corner of Western Australia between longitudes 115° O'W. and 116° O'W. and latitudes 33° 15'S. and 33° 45'S.The general geology of the area is shown in Fig. 1 where the control of the physiography exercised by the Cape Leeuwin-Cape Naturaliste basement ridge is readily apparent. Between this ridge and the Precambrian east of the Darling fault lies the southern part of the Perth basin which contains outcropping Jurassic to Recent sediments and lavas (McWhae, et al., 1958).The Leeuwin-Naturaliste ridge is the exposed portion of L Assistant Production Managcr. The iron-mines of the Ilsede Hütte Co. are at a town called Peine, about 20 miles east of the city of Hanover, on the railroad to Brunswick (Braunschweig). Hanover, the capital of the province, is a military city, of approximately 250,000 inhabitants, and Brunswick, 33 miles to the westward, has half this number. The mines here described are located in a hamlet called Bülten. The Ilsede Hütte Co. operates two mines, 1.5 miles apart, in this district, Gruber Bülten Adenstadt and Gruber Lengede Bodenstadt. It also operates an iron-mine north of Hanover, known as Eiserhaven, and one in the Harz mountains, the Georg Friedrich, at Grauhof. At Bülten a coarse conglomerate, a, Figs. 1 and 2, contains nodules of limonite, cemented together by calcium phosphate. The ore contains Fe, 25 to 45; Mn, 3 to 4; P, 0.6 to 1.4; S, 0.02 to 0.09; and CaCO3, 40 per cent. Directly above the conglomerate is limestone, b, followed by a mixture of clay and sand, c. Below the conglomerate is a hard clay floor, d. The ore-body, from 10 to, 12 km. long, and from 3 to 4 km. wide, has a maximum thickness of 20 m. It clips approximately 10° S.E., and strikes N. 45° E. Diamond-drill prospecting shows that the thickness diminishes to 1 m. as the end of the deposit is approached to the northward. At this point the deposit is 250 m. below the surface. In Fig. 2, the arrow, A, indicates the general direction of the work along the face, a, which is carried forward in a straight line for its entire length. At B, a train is approaching, which has come from the bench-track, shown at G, by a circuitous route, and is dumping the overburden behind the face, in the space left by the excavated rock. The risk of allocation in construction contracts is a primary concern for all parties. For contracts involving subsurface construction the allocation of site condition risk is critical. In the past one hundred years technological advances fundamentally changed how that risk is allocated; yet another shift in this risk allocation may lie just over the horizon due to advances in geotechnical data management. Around the world initiatives are underway to make geotechnical datasets more open and accessible. In the United States some states like Kentucky have already made geotechnical data readily accessible. This proliferation of geotechnical data in the U.S. may impact the allocation of subsurface risk in construction contracts. Many construction contracts contain a differing site condition clause. That clause allows for a modification of the contract price or schedule if the ground conditions encountered by the contractor differ materially from either what was indicated in the contract documents or would be reasonably expected. A contractor, however, is typically not entitled to that modification if the contractor knew or should have known of the adverse conditions encountered. Courts have interpreted the “should have known” language as requiring contractors to make a reasonable site investigation prior to bidding the project. If geotechnical data is available and accessible and reveals the adverse condition the contractor encounters, courts could find that the contractor should have known of the condition and thus will not be entitled to a modification based on the differing site condition clause. Accordingly, the U.S. could be on the threshold of significant shifts in how the risk of differing site conditions is allocated in construction contracts.
