Rehabilitation work at the Cameron Run Tunnels entailed the restoration of seven heavily deformed, approximately 69 m long, steel liner plate supported culverts through a CSX Railroad embankment near Alexandria, Virginia. A custom fabricated expander, equipped with four 200-ton hydraulic jacks on two expansion arms was used to push back the liner plates encroaching into the proposed tunnel profile and install the steel set support. In a second phase the tunnels were then lined with 16 cm of fiber reinforced shotcrete. Geotechnical instruments both in the tunnels and on the railroad embankment were used to monitor the effects of the rehabilitation work on the two CSX Railroad tracks above the tunnels. Freight and passenger trains were required to run uninterrupted and at maximum speeds throughout construction.

In the search for the development of more "environmentally friendly" and more intensive waste disposal approaches to meet more and more stringent environmental regulations, thermal plasma-based processes? are considered one of the most promising alternatives to well-established technologies such as incineration. This paper presents an overview on the research and development status of thermal plasma-based waste remediation technologies. The properties of thermal plasma are described. Due to its unique feature of high-energy intensity and super high temperature, thermal plasma is particularly capable of destroying organic-containing wastes. Its potential and promising application to waste remediation may include: treatment of incinerator ashes; metallurgical dusts (especially, electric arc furnace dust); medical wastes; radioactive wastes; and other Resource Conservation and Recovery Act (RCRA) listed hazardous wastes. Many research institutes and vendors have been involved in the development of thermal plasma-based waste treatment-technology encouraged by the cleanup programs supported by the Environmental Protection Agency (EPA), the Department of Energy (DoE) and the Department of Defense (000). More recently, thermal plasma-based waste treatment technologies (sometimes called plasma-enhanced pyrolysis) are focused more and more on not only just destroying organic wastes but also on how to practically, and economically recover energy contained in the organic waste materials in addition to the recovery of metals in order to offset the high operating costs.

Non-ferrous metals and metals in general are considered as being non-renewable natural resources. Metals are needed because of their excellent and irreplaceable properties. The consumption of metals, with the exception of carbon steel, is steadily growing by 1-3 % annually, and that of stainless steel as much as 3-6 %. This is a general trend, which is periodically disturbed by cyclical variations. In recent years so-called "New Economy" has become prominent in the public media and the market value of the traditional industry has been well below its real value and importance. Nevertheless, the modem society requires metals today and also in the future, and the companies using the most modem technology in a responsible way and innovative solutions not only in technology, but also in everything they do will survive. This paper describes the role of Europe as a producer of primary base metals and as a supplier of technologies in the base metals industry. It concentrates on the development and commercialization of technologies and project implementation in the metallurgical industry. As one example of a European approach to these matters the paper presents Outokumpu' s response to the future challenges in the base metals industry. Outokumpu Oyj is one of the leading metals and technology companies in the world of stainless steel, copper, zinc, and sales of technology in metals and minerals businesses. Outokumpu applies its knowledge of metals and processing to generate value for its customers and shareholder. The decision to contract or owner mine should be independent of, and should be made before, definitive estimated cost comparisons could be available. There is substantial potential risk of estimated cost comparisons being flawed due to difficulties in compiling comparable estimates for differing business objectives, errors and omissions or because of significant bias. In the current economic environment, escalating cost pressures potentially lead to increased incidence of disputes in mining contracts. The apparent cost of contractorÆs profit and overheads has tended to become more significant to owners. Economy-driven trends towards higher levels of performance and commercial risk for contractors, and the potential for more adversarial, difficult management; with attendant disputation between contractors and owners, have encouraged development of so-called ærelationship contractsÆ û partnering or project alliance contracts. The paper discusses the issues, circumstances when owner mining or contract mining is favoured and perceived advantages and disadvantages of contract mining. The implications of owner-perceived core business and core skills and outsourcing are also discussed. Techniques of introducing objectivity into the decision to owner or contract mine using matrix analysis or benefit comparisons are described. A disciplined procurement process should deliver a decision to owner or contract mine independent of, and prior to, any definitive comparison of estimated costs. A generic procurement process model is provided as a basis for discussion. Risk is discussed generally and as a significant factor in comparison of estimated operating costs. Consideration of risk and any prudent cost treatment are promoted as necessary pre-requisites to any comparison of estimated costs. The paper develops the concept that the decision to owner or contract mine should be based on real benefits that become obvious in the early stages of the development, particularly the procurement process; and before definitive estimated cost comparison can be available. In the context of this concept estimated cost comparisons tend to be confirmatory. Problems with comparing estimated ownerÆs operating costs with tendered contract prices are also discussed, particularly recovery of capital cost of equipment; and the owner minerÆs trade-off of operating risks for the residual contractorÆs margin attributed to overheads and profit. The paper concludes that sole reliance on a comparison of estimated ownerÆs operating costs with tendered contract prices in deciding to owner or contract mine is questionable and likely driven by a need to satisfy specific in-house customers.

The complexity of commercial mining software has gained rapidly over the past decade as hardware developments have surpassed software capabilities at a staggering rate. Software users, recognizing the limitations of off-the-shelf applications, have adapted embedded scripting languages. Custom programming has always had a vital role in mine computing innovations, yielding a dynamic research environment in industry and academia. Fields such as industrial minerals can benefit from customization of existing software, since the majority of mine planning software was designed for large metal mines. Different customization approaches utilizing embedded scripting languages are presented, with examples of sand and gravel applications in development. Following implementation by Surpac and development of the Surpac Command Language, Tcl has been widely applied. Mintec introduced Python, also extensible and portable amongst various operating systems, for use in their MineSight products. In early 2000, Gemcom introduced the use of Microsoft Visual Basic for Applications, widely used customization tools for a decade. Datamine implemented a flexible multi-language approach, with all program commands and processes available through the COM Server Interface. This extends customization from the existing macro language to scripting in HTML, JavaScript, or any language that supports COM.

"It is a widely held view that in the 21st century, the mining industry will be dominated by a relatively small number of large companies, truly global in scope and internationally staffed (Gooding, 1997). Interestingly enough, most of the exploration and exploitation activities are being carried out by junior and major mining companies from common law jurisdictions in civil law countries, in particular in Latin America, where in recent years, the region has ranked first as a destination for exploration dollars, thanks to the reforms undertaken by some countries to amend their legal framework to attract foreign investment. From a lawyer’s point of view, this is where the main challenge lies: how to bridge the gap between the two legal systems.In order to avoid pitfalls, common law lawyers should be more diligent and proactive when dealing with civil law jurisdictions, given the different systems of law, standards, traditions and customs. Common law lawyers cannot be expected to be well-versed in civil law but they should not be completely unfamiliar with it either. A balance should be struck to ensure clients’ needs are professionally taken care of and that common law requirements and standards are met."

Steel refining reactors based on chemical heating are being used as an alternative to ladle furnaces. They show a high degree of flexibility in respect to heating rate in addition to carrying out refining reactions such as de-S, inclusion removal, alloying etc. IR-UT and CAS-DB are examples of such reactors. Their performance is dependent upon geometrical characteristics as well as operational conditions which determine the flow field inside the vessel. A physical model of the IR-UT process of the Companhia Siderurgica de Tubarao, steel plant located in Serra, Espirito Santo, Brazil, was developed to assess the features of the flow field and its influence on the metallurgical behavior. Results of the physical model were used to optimize the process parameters in the industrial unit.

The urban environment presents special challenges for the design and construction of earth retention systems. Complications arising from difficult subsurface conditions are compounded by the presence of urban infrastructure and existing and prior construction. The proximity of adjacent structures as well as intense prior use can cause special concerns including the potential for archeological artifacts or contaminated ground or ground water. Utilities and structures may be particularly vulnerable to the effects of ground movement, dewatering and vibrations. Difficulty of access, congestion and limited work areas may severely restrict means and methods of construction. Dewatering may be limited or prohibited because of concerns for disposal of clean or contaminated water, depletion of aquifers, drawing of contaminants to the site or dewatering induced settlements.

"6.1. INTRODUCTIONThis chapter comments on some of the more common types of agreements related to property examination and acquisition, other than the farm-in/joint venture agreement or common undertaking, which is dealt with in the next two chapters. Many of the comments made in Part IV of Chapter 4 apply equally to any such agreement. In addition, many of the comments in Chapter 8 and the examples in Volume II are most certainly relevant to many other types of agreement.6.2. RIGHTS OF FIRST REFUSAL1A right of first refusal is a right that obligates an owner to offer his property, or an interest therein, to the holder of the first right if the owner intends to sell or otherwise dispose of it. It may be triggered either by the owner wishing to offer his property for sale or by receipt of a bona fide offer to purchase his interest from an “outside” third party. The mechanics and procedures to implement a first right should be set out clearly in the agreement, and their basics are the same, whether the first right is a stand-alone document or is part of an acquisition agreement.2Rights of first refusal are common in agreements to permit some control over the disposition of an interest and there they can be a valuable provision. However, some explorationists feel that they are also a good stand-alone agreement to have while a property is being evaluated to decide whether or not it is worth optioning. The reasoning is that such an arrangement will tie up the property to allow a quick look and, if the property looks interesting, the balance of the term of the first right will give an ample exclusive period of time to negotiate with the owner and settle an acquisition agreement. In addition, the explorationist is protected by the first right if the owner decides to negotiate a deal with another party."

Gas stirring, simultaneous arcing, chemical additions are some basic steps in the secondary steel making. From tap to team however, there are enough uncertainties and several in-situ decision making required to match the fmal composition and temperature in the given amount of processing time. Currently available control algorithms rely on overall material and heat balance coupled with a self-learning regression based tuning of model constants. In this paper we demonstrate the capabilities of Computational Fluid Dynamics (CFD) in modeling and analyzing the thermo-chemical aspects of secondary Steelmaking. These models take advantage of scientific and engineering advances in computational tools and provide almost real time speed of analysis. This can be a very effective tool for operator training, process debugging and improvement as well as new innovations. Traditionally, mineral reserves management at most underground mines in Zimbabwe focus on maintaining large mineral reserves so that the time between development and production is as long as possible. Historical data at Shabanie mine, a Zimbabwean sub-level caving underground mining operation, confirms this practice. However, the high cost of underground development means that the luxury of large buffer mineral reserves cannot be justified. Furthermore significant increases in the costs of production, exacerbated by the current unfavourable economic climate, make the wisdom of extending development workings well ahead of use questionable. Poor ground conditions at Shabanie mine, mean that some development ends have to be re-mined two or three times due to partial or complete closure between the time they are mined and the time they are utilized. In order to reduce the inordinately high support costs associated with closure of development ends a new ?just-in-time? (JIT) approach that provides development ends as and when they are needed, has been adopted. Accordingly a model to determine an appropriate ?just-in-time? rate of development has been created. The JIT development model indicated that the mine could reduce development rates from 330 m/month in 2001, to 160 m/month in 2002 and achieve savings of about 50% on annual support costs, but still assure customers of a long-term product supply. The mine accepted the model in November 2001 and began implementing it in 2002. Results of the implementation will be reviewed in 2003.

Thermodynamic data concerning FeO-containing slags is of importance in ladle refining of steel. With a view to generate a set of reliable and self-consistent thermodynamic data for these slags, experimental determination of the activities of FeO in binary and ternary slags was carried out using the gas equilibration method involving CO-C02-Ar gas mixtures at steelmaking temperatures. The slag samples in Pt crucibles were quenched after the equilibration and subjected to chemical analysis. The thermodynamic activities of "FeO" in the slags were calculated from the experimental data. The results are incorporated into a thermodynamic description of silicate melts in the present laboratory. The model is based on a Temkin-Lumsden approach and is able to compute the thermodynamics of higher order systems from the lower order ones.

"7.1. INTRODUCTIONThis chapter addresses the joint venture and examines a number of general concepts of the joint venture relationship. Chapter 8 looks at some specific concepts related to the provisions of a joint venture agreement, which are equally applicable to a shareholders’ agreement or other contractual relationship. The term “joint venture” is used because the author is a common law solicitor (a matter of convenience for which apologies are offered to civil law readers), but it should be noted that, in many aspects, the legal structure of an entity is irrelevant. It is the relationship of the parties, be they venturers or shareholders, that is important, and the areas of concern are surprisingly similar (except for terminology).The details of the joint venture relationship and agreement could fill several books. Accordingly, this chapter and the next focus on selected topics that appear to have caused problems or confusion or to be the basis for disputes. And remember that, although the following discussion is in the context of a joint venture, many of the comments apply, either directly or indirectly, to virtually any common undertaking and the agreement defining it.For interest’s sake, this chapter starts with a summary of some of the earlier types of agreements and arrangements that have evolved into the joint venture agreement of today in Canada, the philosophy of their format, and the reasons for their demise.7.2. EVOLUTION OF THE CANADIAN JOINT VENTUREThe Early DaysMuch of the opening up of Canada’s north is due to exploration for and development of mines. The early discoverers were relatively free to roam and explore at will and, if they were fortunate enough to find something, they dealt with the appropriate government to acquire exploitation rights. The early interests lay in gold or silver. Workings were small, usually worked by the owner alone or with only a couple of helpers to extract the native gold or silver. If the owner wanted to move on, he could sell his property outright and use his stake to look elsewhere.As logging and mining camps were opened, the development of better roads and railways made access easier. Entrepreneurs saw the opportunity to make money by assembling large parcels of land and working them as a single operation. In order to do this, some owners who were not ready to sell out had to be convinced to do so through more attractive offers"

"4.1. INTRODUCTIONThis chapter, although divided into four parts, deals with only two principal topics. The first briefly describes and discusses some common types of property interests and considerations relating to them and the second deals with entering upon privately owned lands and obtaining the consent to do so.It should be noted that the terms “mining rights” and “mineral rights” are used interchangeably. As so used, they include the right to exploit the minerals and dispose of them for the benefit of the owner/lessee. This is relatively common in common law jurisdictions. In some jurisdictions, the two terms have distinct meanings, with “mining rights” referring to the right to work or exploit the minerals and “mineral rights” referring to the minerals themselves.Finally, it must be mentioned that the comments in the Introduction and §§ 4.2., 4.3. and 4.4. are based primarily upon Ontario law and Ontario’s mining and real property systems of registration. They have been included for illustrative purposes.4.2. LICENCES, CLAIMS, AND LEASESIn most jurisdictions, there are several basic types of interests that can be obtained from the state for mining purposes and that are of interest to the explorationist, as opposed to the operator. Different jurisdictions will have variations of these and possibly some extra ones that will address special purposes or local concerns. In virtually every jurisdiction, privately owned property rights are obtained through negotiation between owner and acquiror.Exploration or prospecting licence. This licence grants to the holder the right to prospect over a large tract of land and the exclusive right to acquire mining claims within that tract for the term of the licence. Such licences are usually negotiated documents requiring a minimum expenditure during the first year (often secured by a deposit or surety bond) and minimum annual expenditures thereafter to continue the licence in force up to its full term. The term will rarely exceed four years. The number of claims permitted to be staked will be limited in some way, possibly as to a maximum aggregate area or a maximum number of claims per annum. It is normal for the holder to have to drop part of the licensed area each year, so that the area shrinks annually, although exploration expenditure requirements will usually increase.These types of licences are usually used by governments to encourage exploration of otherwise unattractive or remote areas, such as the far northern parts of some of Canada’s provinces. They do not grant any real property interest in the area for which they are issued, and they will be subject to any claims or property rights that exist in the area. They are contracts with the state that grant certain exclusive rights in return for commitments to carry out work. They may or may not be specifically authorized by statute."

Korea Zinc commenced zinc production in 1978 with a capacity of 50,000 tpa. Since then, continuous investments have been made and resulted in Korea Zinc now being the biggest zinc and lead producer in the world. In the course of increasing zinc production capacity, the company management realized that the company needed a lead smelter to prevent the solid waste disposal problems by treating the lead containing solid waste. This paper begins by briefly stating the objectives and the roles of the lead smelter at Onsan. It describes the QSL process and the TSL process, and further extends the description of the TSL process, through which harmless inert solid waste could be produced for secure final disposal. It is also mentioned that the TSL process plays an important role in the integration of zinc and lead production. Throughout the paper, a positive attitude in handling the environmental issues in the non-ferrous smelting industry is emphasized. Finally, a solution for the solid waste disposal problem in the zinc and lead industry is proposed, with which the environmental issues can be an opportunity rather than a crisis. The current operation at Onsan suggests the future direction of the non-ferrous smelting technology that all of the zinc and lead producers should pursue.

"11.1. INTRODUCTIONA royalty is the most common form of interest retained by an owner who is disposing of his property or by a joint venturer who ceases, voluntarily or otherwise, to participate in the joint venture.1 Rarely does a non-participating party have a direct interest in the property and/or assets of a project, except during the period when a non-participating joint venturer may be having his interest diluted.2 In fact, it is most unwise to permit a non-participating party to have such an interest. It may give rise to significant problems that could prevent or substantially delay the development of an orebody and require a considerable amount of time, effort, and money to correct.3In negotiating a royalty, it is important to be aware that there is no law or convention that says, “You just don’t do that in a royalty agreement.” As with any agreement, inventiveness and flexibility on the part of the negotiator are not just assets, but virtual necessities. It is also for this reason that it is essential to read the royalty provisions, particularly the definitions, fully and carefully, especially if you are the recipient. On the other hand, if your inventiveness and flexibility cause your accountant to question the advisability of one of your ideas, pay close attention to him.4 He will, no doubt, have had experience with many royalties, and no competent professional adviser disparages a client’s ideas without good reason. Besides, he will probably be the person who will be determining the royalty or certifying the determination of it. At the very least, he will be auditing your general financial statements, which must, of course, reflect the royalty determination. Heeding his advice not only may make the determination easier but also will probably save you money in professional fees later on. Nevertheless, do not simply accept his comments or recommendations without understanding what they mean, why they have been made with respect to your royalty agreement (sometimes professionals have comments that they make as a matter of course and, even though they may be valid, you should require them to be justified to you), and how they will affect your royalty determination.It is surprising how many corporate payors insist that their standard royalty provisions5 be used as a matter of policy, thereby effectively tying the negotiator’s hands. It is even more surprising, and to professional advisers frightening, how many of the senior employees who insist that such a policy be adhered to, virtually without variation, do not know what is in the standard provisions and would be hard-pressed to explain them to a property owner. If standard provisions are appropriate, by all means use them, but do allow experienced and sensible negotiators some flexibility and make sure that everyone within the corporation who may have to use such provisions – negotiator and supervisor alike – knows what they contain and why they are as they are. For example, there are often good and convincing reasons to describe a deduction in a certain way or to include a certain specific type of deduction. On the other hand, quite often the answer to the question “why?” is that “it has always been there”; this is, or should be, an unacceptable answer. In any event, if you, as the negotiator, appear to know what you are talking about, are familiar and comfortable with your royalty provisions, and are backed up by your boss with the same words or reasoning, a property owner cannot help but be satisfied that you are knowledgeable, even if he still does not agree with your provisions. Finally, if you do use standard provisions, make sure that they are reviewed and updated regularly."

It is said that the 21st century will be an era of the remedy of the global environment. In order to reserve natural resources for the future and to avoid the dispersion of heavy metals after usage and to avoid pollution problems, it is extremely important to recycle heavy metals as much as possible by reasonable recovery procedures. The nonferrous metal industry is expected to play a important role in the recycling of heavy metals that are originally their products. From the depressed metal price experienced in Japan in 1980'h due to the sudden change in current exchange rate between US dollar and Japanese yen, one of major nonferrous metal company, Dowa Mining, has diversified its business area not only to the so-called down stream, but also to the environmental business including metal recycling, industrial waste treatment and soil remediation by utilizing technologis and facilities once used or still used for mining and smelting of copper, zinc, lead and precious metals. In this paper some of these applications will be presented.
