Environmental rehabilitation has increasingly become a central concern in the regulatory and fiscal landscape governing South African mining operations. A key issue within this domain is the extent to which mining entities may claim tax deductions for expenditures incurred in fulfilling their environmental rehabilitation obligations. The Supreme Court of Appeal's decision in Sishen Iron Ore Company (Pty) Ltd v Commissioner for the South African Revenue Service [2025] ZASCA 16 addresses pivotal questions regarding the tax treatment of such expenditures. The judgment offers authoritative clarification on the interpretation of the Income Tax Act 58 of 1962—specifically sections 11(a), 11(c), and 36(11)(e)—as they pertain to mining activities and the environmental responsibilities imposed under the Mineral and Petroleum Resources Development Act 28 of 2002. This commentary critically examines the multifaceted implications of the Sishen ruling, highlighting the intersection of statutory interpretation, operational realities, and environmental accountability within South Africa’s mining sector.

On June 25, 1999, BHP Billiton (BHPB) announced the suspension of operations at the BHP Copper Inc.(BHP) San Manuel copper mine in Pinal County, Arizona. Subsequent to this announcement, BHPB aggressively pursued a number of alternatives for the underground mine and open pit facilities, including continued curtailed operations, sale to a qualified mining operator and closure of the property. After consideration of these various alternatives over a 2.5-year period, BHPB announced final closure of the mine site on January 15, 2002.This paper describes how the BHPB charter and HSEC policy apply during the closure process.

The metallurgical history of Republic has been completely reviewed in a paper presented at a previous meeting of the Spokane Local Section by Professor Thomson;' therefore, the present paper will be confined to matters directly pertaining to the San Poil mill: When I came to Republic last fall to look over the situation there was a plant in operation successfully treating the tailings from one of the earlier mills in the camp. I refer to the mill of the Rathfon Reduction Co. This mill was operating in accordance with modern cyaniding practice, and I was given to understand that the work was very satisfactory and profitable, else it would not have been continued as long as it was. At that time I obtained much metallurgical information of value from Harry W. Newton, Superintendent of the mill of the North Washington Power & Reduction Co. I took a number of samples from the San Poil mine, with the view of determining if Mr. Newton's experience with the ores from the other mines applied to the San Poil ores. I made a large number of tests under a variety of conditions, and found that it was possible to extract as high as 98 per cent, of the values from San Poil ore by the laboratory-tests when the ore was pulverized to 200-mesh and treated with a solution of a strength of 5 Ib. of KCN to the ton. DSI DYWI Rock Dust application is aiding in enhancing safety and productivity in underground coal mining. DSI DYWI Rock Dust combines wet dusting technology and polymers to allow for drying and lift characteristics for rock dusting. DSI DYWI Rock Dust typically dries within 24 to 48 hours depending upon the mine air velocity and humidity. The DSI DYWI Rock Dust Applicator Machine is a completely hydraulic unit. The DSI DYWI Rock Dust Applicator machine allows for batching of product and face spraying operations in permissible locations. The DSI DYWI Rock Dusting Applicator Machine fits in one half of a battery or diesel scoop bucket for ease of transport. It is completely hydraulically powered by the PTO circuit. The DSI DYWI Rock Dust Applicator unit requires a scoop operator, and a person to operate the spray wand, simple operation with two personnel. The first demonstration was at an underground continuous miner room and pillar coal mine which produced a pilot test period opportunity, which proved to be successful, and has now been in full launch mode with the US underground coal mining industry. A typical batch of operation allows for 250? of roof and rib (19? wide by 6? in height) coverage of DSI DYWI Rock Dust application. The DSI DYWI Rock Dust Applicator contains a hydraulic powered air compressor which allows for 30-50% more coverage per batch by improved dispersion of product via air assist spray nozzle. DSI DYWI Rock Dust will add approximately $0.02 to $0.04 per clean ton of coal cost to the mining operation over traditional rock dust cost depending upon mining height.

The risk and consequences of community rejection and loss of a social licence to operate is well articulated (Moffat et al 2018), however, the means for systematically managing this risk are less established. At the local scale, a mining operation is said to have a social licence to operate (SLO) when it achieves ongoing acceptance or approval from the local community and other stakeholders who can affect its profitability (Graafland, 2002). Without this social acceptance, it is very difficult for a business to operate effectively or profitably. It is well understood that social (or community) acceptance of a mine and its associated operations is a reflection of the quality of the relationship a company has with their host community (Thomson & Boutilier, 2011; Lacey & Lamont, 2014; Parsons et al., 2014; Moffat et al., 2015). Community relations are an integral part of successful mining operations and where these interactions are effective, they tend to foster mutual understanding, trust and support between a company and the host community (Kemp et al., 2006; Holley & Mitcham, 2016). Research further demonstrates that where such interactions are perceived to be procedurally fair, the increased trust created in these company-community interactions tends to lead to higher levels of acceptance of mining operations (Moffat & Zhang, 2014; Lacey et al., 2017).The challenge, however, is how to listen systematically to communities that mining and associated operations; communities that are often located across vast geographic areas and with diverse demographics. To date, traditional methods deployed to both guide and evaluate community engagement and social investment activities have been challenged to reflect the nature of the phenomenon they seek to observe, the voice of community. For example, detailed baseline surveys of community attitudes every three years by companies, as is the requirement within the policy frameworks of most large miners, provide rich insights but do not reflect the dynamic, temporal nature of the relationships that underpins their SLO. These processes typically are largely opaque to communities and distinct from the company’s engagement activities. The CSIRO Local Voices project was developed with Rio Tinto to go some way towards meeting this challenge of how to listen to the voice of community systematically. It is felt that prior to the presentation of the technical portion of this paper, some general information would be of interest. The Sar Cheshmeh Copper Mining Company was founded by the Iranian Government to oversee the design and construction of Iran's first copper smelter complex, which will be another step in the industrialization of Iran. Since this is the first such plant in Iran, Sar Cheshmeh wisely chose to enlist the technical assistance needed in regard to the facilities requiring engineering and operating know-how from outside of Iran. To obtain the foregoing, SCCM signed a contract with Anaconda-Iran, Inc., which was formed by The Anaconda Company for this project. The general scope of this contract covers the overseeing of engineering and design by Parsons-Jurden as well as physical plant construction. In addition to this, the same services were given to water supply and tailings disposal systems which were not included as part of the Parsons-Jurden contract. Anaconda-Iran is also assisting SCCM in setting up a training program for Iranian personnel for plant operations, administration, etc., which .will go on for some time after the plant startup, under the guidance of Anaconda-Iran expatriates. SCCM?s other responsibilities, in respect to the development of this industrial effort, are the building of a townsite for approximately 2200 families, the expected manning requirements, having all the facilities necessary to provide a pleasant life in a remote area. It has been estimated that the manpower for operations will be 2050.

Low-grade porphyry copper ores containing chalcopyrite as the primary mineral was leached by two strains of acidophilic, thermophilic microbes belonging to the genus Sulfolobus. Leach tests were conducted in glass columns heated to 60-70° C. Pinto Valley and San Manuel ores sized to -1/2 inch + 50 mesh were effectively leached by the thermophilic organisms, but pinto Valley and Cyprus Bagdad ores sized to -2 inch + 1/2 inch resisted leaching. Aeration did not contribute measurably to bacterial copper extraction, since two columns, one inoculated and one sterilized, having a rest/ leach cycle without recurrent aeration exhibited copper extraction patterns similar to those of the aerated columns. Distilled water can be substituted for 9K medium without diminishing copper extraction. Decreasing the pH of the leachate to about 1.8 enhanced the extraction of copper from pinto Valley ore with the thermophilic microbes. Thiobacillus ferrooxidans was found to be relatively ineffective at copper extraction from pinto Valley ore. Of eleven solvent extraction reagents tested, Adogen 364 and Warsol at concentrations of 0.1% and 0.012 were inhibitory to oxygen uptake by the two Sulfolobus strains. Di-2-ethyhexyl phosphoric acid at concentrations of 0.1%, 0.01% and 0.001% were totally inhibitory to the respiration of both organisms.

Surface subsidence events induced by underground longwall coal-mining operations can cause various disturbances to surface structures, ranging from integrity and stability to functionality problems. Highway bridges, as a kind of special road construction that can only tolerate smaller movements and deformations than road pavements, are particularly susceptible to severe influence caused by subsidence-induced ground movements and deformations. However, based on accurate subsidence prediction and correct influence assessments, efficient and effective mitigation and remediation measures can be designed and implemented to ensure the continuous service of bridges, safety of travelers, and smooth mining operations. In this paper, based on the predicted final and dynamic surface movements and deformations, the techniques to assess subsidence influence on the integrity, stability and functionality of bridge structures (such as decks, beams and abutments) are presented. A number of mitigation measures to protect bridge structures are recommended, along with an actual application case.

It is proposed that a waste rock dump be constructed on slopes consisting of soft colluvium and weathered Chim Formation mudstone at the Porgera Gold Mine, in Enga Province, Papua New Guinea (PNG). Geolog- ical, geomorphological and geophysical investigations were conducted in support of geotechnical studies to assess the physical character of the 6km2 site. Geomorphological studies focused on the extent and nature of colluvium cover and landslide activity. Detailed ground traverse mapping resulted in classification and delineation of eight terrains and seven material types. Seismic refraction and resistivity profiling, combined with drilling, provided subsurface data. Results were presented as standard profiles, coloured contoured sections and plans. Subsurface features, including deep colluvial channels, buried cliffs, slump blocks and buried alluvial channels, were identified. Results of the combined investigations allowed designers to model the colluvium/ bedrock surface and identify critical areas of deep, mobile colluvium and weak bedrock. A design approach was developed which accounted for the morphology of landslide systems and distribution of colluvium types.

Statistics showing that mine rehabilitation is falling behind rates of disturbance continue to be reported in the media. Unfortunately, most reported statistics do not account for the large growth-cycle that mining in Australia experiences, where there are typically significant new disturbances with large portions of these areas not being available for rehabilitation for a number of years. Many commentators assert that better planning is required to ensure that rehabilitation will be able to achieve a safe, stable, non-polluting landform that meets the agreed post-mining landuse.This paper focusses on the revegetation aspects of mine rehabilitation and in particular the matters that need to be addressed in the planning stage so that revegetation success is ultimately able to be demonstrated to regulators and other stakeholders.CITATION:Fox, S D and Swart, P B, 2018. In most copper refineries, addition agents are added at predetermined rates with no further monitoring of their activity or concentration in the electrolyte. Increasingly stringent cathode quality requirements, and a desire for better process control in tankhouse operations, have recently directed a number of refineries to search for a better addition agent control strategy. Extensive development work has been carried out at the Noranda Technology Centre for the monitor in of glue and thiourea in copper refinery electrolyte using cyclic voltammetry (cv~. Data from both synthetrc and commercial electrolytes are presented, showing the ability of CV to produce reliable and easily identifiable fingerprints of addition agent concentrations in copper refinery electrolyte.

THE problem of drying ores is one that most mill-engineers are sooner or later called upon to meet, and it may be timely to point out sortie of the difficulties resulting from such operations from purely a metallurgical and economic stand-point. We mean, in the following pages, to discuss primarily the effect of such operations on. the ore itself, without particular reference to the mechanical or cost features of the subject; That an appreciable tonnage of the ore fed to the usual form of drier, either rotary or stack, is lost, is fairly well appreciated, but we believe that only a few mill-managers know just. what their drier-losses amount to, and we have found that in most cases they console themselves with the fact that the drier-smoke is not very much discolored, and it is generally believed that the draft is not sufficient to carry away more than a. negligible percentage of the values. The drying of ores is becoming an important factor. since the more general application of magnetic, static, and dry-table treatment. Its importance in the field of metallurgical operations warrants a close examination into its effects. This subject has been repeatedly brought hone to us, and while the drier-losses, in every case examined, have considerably exceeded even the most generous estimate, an attempt at a recovery of these values is rarely made. We have found that the losses resulting from drying-operations can be effectively recovered, at a low cost, and believe that the publication of the results of a number of investigations along these lines will be of interest and benefit to the profession at large. This paper discusses the geotechnical condition of bedding shears and small- and large-scale faults and shears in Archean banded iron formation (BIF) bedrock, based on observations of core and televiewer images. Information that can be collected includes the orientation of defects, infill thickness, strength and material type, defect shape and surface roughness.The spacing and continuity of bedding shears may be critical to slope design where performance is structurally controlled with bedding dipping out of a wall. The intensity of development of the bedding shear is a useful indicator of the amount of shearing a bedding surface has been subjected to. This can allow for engineering judgement to be used in adopting peak or residual shear strengths along defect surfaces when developing the design.The spacing and continuity of bedding shears may also contribute to the blockiness and degradation of a rock mass where the structural orientation is otherwise favourable. Additionally the condition, thickness and strength of infill of major fault structures can affect slope design and performance, depending on orientation.Comparison of the condition of structures observed in core with the corresponding in situ televiewer image has been made to assess what characteristics are most accurately captured by each technique and whether the additional information gathered from using the televiewer technique is justified by the cost. "Abstract Pile foundations are often used for important structures, and thus, reliability evaluation is an important aspect of the design. Reliability methods have become increasingly important as decision support tools in different areas. The main benefit of reliability analysis is that it provides quantitative information about the parameters (uncertainties) that most significantly influence the behaviour under study. In particular, the design of pile foundations still involves many limitations and uncertainties, particularly when there is not enough investment in soil characterisation and/or pile load tests. In addition to the uncertainties associated with soil characterisation, physical, statistical, spatial and human uncertainties exist. In this subject, the primary purpose of this paper is to demonstrate the application of reliability methods to geotechnical pile design (axial load). It also presents a simple and practical approach to performing it using Monte Carlo Simulations, intending to provide knowledge for code harmonisation and encouraging the development of such methodologies in geotechnical practice. Sensitivity analyses are shown to understand the influence of each uncertainty type coming from different sources. An application example indicates, corroborating other studies, that the model error is the most influent uncertainty. As such, when using the different models (SPT-, CPT- and PMT-based) for bearing capacity, the results emphasise the need for a well-defined and wellcharacterised resistance model, also these results allow the engineer to understand how important the load tests can be to achieve reliable results and economic designs.1 IntroductionUnlike the approach to reliability evaluation used in structural engineering, the traditional procedure used in geotechnical designs addresses uncertainties through high global or partial safety factors (SF), mostly based on past experience. However, this approach to addressing uncertainties does not provide a rational basis for understanding their influence on design.Furthermore, the new regulation codes and social concerns, such as the sustainability or the economy, are imposing geotechnical engineers to increase their ability to deal with uncertainty in a direct and more rational way. Designs should be economic, sustainable and reliable at the same time. Concerning the reliability part of design, different approaches can be done, but the most important thing to keep in mind is the simplicity and efficiency of the tools and applied methods."

Entre los objetivos de la mina está el aumento de la productividad a través de la reducción de costos de operación y realizar labores de pre-minado de 20 m/ día en los avances de operaciones. En este sentido, si bien la función del mecanizado es importante para el incremento de la productividad, es necesario controlar y administrar los recursos del nuevo yacimiento. Por ello, para implementar la nueva tecnología del minado es necesario el estudio de mecánicas de rocas y asi determinar la característica de la masa rocosa y la factiblidad económica para excavados mediante el sistema de minado contínuo.

M.S. Azun I do not at all agree with the basic points of the author's conclusion. The use of lognormal or normal model to respond to the attribute distribution function should be carefully questioned. If fitting a distribution function of regionalized variables is the main purpose, one may employ one of certain well-known families of distributions, such as Tukey's lambda functions. For instance, the distribution function of gold assay values studied by Krige (Krige, 1978) may fit the lognormal model well, but one should not exclude that the basic idea of using the distribution function of observed data is to have insight of the physical mechanism that gives rise to the regionalized variables. In Applied Geostatistics, there are many examples considering only lognormal or normal model for the distribution function of geostatistical data even if the observed distribution function has more than one mode. Of course, using lognormal or normal model always brings easy computation for the statistical properties of attribute under investigation. Still, I object to adopting any of those models without having any "statistical inference." As seen from the author's paper, lognormal and normal model produce the same average grade (0.746% copper) and almost the same sample variance. Therefore, which model explains the probabilistic behavior of ore deposit is always an important question that should be replied by the geostatistician using not the common sense but the statistical and probabilistic methods. For kriging procedures, such as linear kriging, one should describe either second order stationary properties or bivariate properties of regionalized variables. Second order properties, such as correlogram function or semivariogram function, are the inputs of the so-called kriging equations. Selecting one of any useable models for the observed second order properties, such as spherical model, is not easy since the models are not based on the correlations structure of the regionalized variables. How those models being used in Applied Geostatistics can be distinguished is another important problem. One may develop many fitting models to respond to the observed second order properties of regionalized variables. However, I suggest that the model should be based on the probabilistic behavior of geologic process. The author used spherical model for copper, wolfram, and silver grades from isotropic sector (Fig. 2, 4, 3b) and exponential model for silver grades obtained along raises in isotropic sector (Fig. 3a). It seems that those semivariograms given in Fig. 3b for isotropic sector and Fig. 4 may be described by the random model implying that regionalized variables do belong to renewal process (Azun, 1983). If I knew the total number of data points used in estimation, I may prove that my conclusion is correct. Recalling the test for the first order sample correlogram value, the test procedure is introduced such that the independence is rejected if [ ] where Za/2 is the a/2 percentile of standard normal random variable and N is the total number of samples used in estimation (Azun, 1983). For the other observed semivariogram functions I suggest the author might try to use the so-called "Markovian model" describing not only the correlation structure of regionalized variables, but also the physical mechanism that produces the regionalized variables. The Markovian model for correlogram function is, [ ] The Markovian model for the other second order properties of ReV are also derived. T ve B, in the above equation, show, for example, structural change and mineralizational variation in a considered deposit, respectively (Azun, 1983). In selecting any model, it is not easy to search for the "best" response to the observed second order properties of ReV's. The Markovian model, based on a theoretical understanding of underlying mechanism, gives more information about the occurrence of regionalized variables and respond to all properties. Random model and the so-called hole effect structure can be easily defined as a special form of the Markovian model (Azun, 1983). An estimation of any second order properties of regionalized variables may be computed through (N-1) lag. However, the dependency between the regionalized variables may be deemed to have "died out" after the so-called stationarity width (range). In practice, the estimation is carried out through 25% of the total number samples available. Therefore, the large fluctuations around the zero level and variance for correlogram or covariogram function and semi-variogram function, respectively, cannot be observed. Since the number of pairs involved in the estimation of higher second order properties is small, the estimation variance at those lags is large. There is no need to show higher order estimated second order properties.
