I 2] STEPHEN ROYCE, * Crystal Falls, Mich.Having examined and reported upon the Steep Rock Lake property and vicinity on several occasions for clients, and having kept in touch with the operation from 1938 on, the writer offers the following discussion of the valuable paper by Messrs. Roberts and Bartley, which was so kindly prepared in response to the writer's earnest request, made as a member of the Committee on Mining Geology. ORIGIN OF THE ORES The writer wishes to express complete agreement with the authors that the origin of these deposits was replacement action by hot ascending sulphide solutions of igneous origin, gaining access via the limestone and dolomite breccia channels, and acting mainly to replace the dolomite and limestone breccia with hematite and hydrated hematite. Some replacement in adjoining greenstones and tuffs by the same solutions may also have taken place, but the latter occurrences may represent replaced iron formations originally bedded in with the volcanics. Iron formation in the same relationship to volcanics is extensively developed on the western Menominee Range of Michigan, in the Middle Huronian belts; also appears in similar relations on the Vermilion Range; and is abundantly exposed in the same stratigraphic position no farther away than the southeast arm of Steep Rock Lake itself. Furthermore, the writer's classification of drill cores, made June 11, 1938, on the prop¬erty, contains the following, for hole 8, in the original strike of the A ore body: "332-342 ore; 342-350 much-leached sugary chert with thin ferruginous slate bands." This is a typical iron formation. The ore in this first group of holes (Numbers 6 to 13, incl.) is described in the writer's 1938 notes as follows: "The ore is hard, massive hematite with some limonite, and shot through with many small vugs." The breccia forms in the float ore and in the drill samples were also noted. As a field classification this does not check badly with Professor Schwartz's microscopic work. Notes supplied by Mr. Neeland, then geologist at the exploration, show: "Hole 23 has some iron formation, not logged yet." It appears therefore that there is some iron formation at the exploration, much iron formation in similar stratigraphic position in the vicinity, and iron formation similarly located as to volcanics on the Vermilion and western Menominee Ranges. Certain of the holes, notably Holes 25 and 27, showed some specular hematites resembling those known to be formed from cherty iron formation elsewhere. Hence the writer concludes that at least a small part of the Steep Rock ores results from replacement of iron formation. By far the greater part of it is, as the authors say, clearly a replaced limestone and dolomite breccia, with the breccia outlines still preserved in much of the ore, and all of the replacement is by hot ascending waters. AT Tahawus, N. Y., National Lead Co. operates the MacIntyre development. Here the world's largest titanium mine produces 5200 long tons of ore per day and pours 8000 long tons of waste rock over its dumps. Concentrated ilmenite is sent by rail to National Lead Co. pigment plants, and a second product, magnetite, is sold to steel producers in raw form or is agglomerated and shipped as sinter. Several earlier attempts had been made to produce iron from the deposits, which have been known since 1826. These attempts failed, chiefly because of titanium impurity. In 1941 the present owners reestablished the operation for production of war-scarce ilmenite, and the impurity became the main product. The Ore: The MacIntyre ore zone is about 2400 ft long and 800 ft wide in horizontal measurements. Ore outcrops were found on the northwest side of Sanford Hill, 450 ft above Sanford Lake and 2500 ft southeast. The zone dips at about 45" toward the lake and plunges to the southwest. The ore minerals, ilmenite and magnetite, are unevenly distributed in bands roughly parallel to the long axis of the ore zone and are interspersed with bands and horses of waste. Hanging wall ores are fine grained and grade from rich ore to waste rock or gabbro. Footwall ores are coarse grained and are almost entirely ilmenite and magnetite. The foot-wall waste rock, anorthosite, is the common country rock. Several faults cut the ore zone. These faults have no great displacement but do contribute to the great physical variations in ore rock and surrounding waste. The Mine: The MacIntyre mine is an open pit operation, with benches at 35-ft intervals. The lowest bench is now 54 ft below lake level. Loading equipment consists of three electric-powered shovels (a P & H model 1400 with 4-yd dipper and two Bucyrus-Erie models 85-B with 2%-yd dippers) and one diesel-powered shovel (a Northwest model 80D with 2%-yd dipper). Ore and waste are transported to a 48x60-in. jaw crusher in ten 22-ton Euclid trucks with 300-hp diesel engines. Ordinarily the two Bucyrus-Erie 2 % -yd shovels load ore into a fleet of three or four trucks. This combination works two 8-hr shifts per day, moving 5200 long tons of ore to the crusher and removing a small portion of the waste rock. The P & H model 1400 shovel, with a fleet of four trucks, loads waste on three shifts per day. The mine operates on a 5-day week, with a small maintenance crew working Saturday. Oversize rock is broken by a dropball handled by an Osgood model 825 rubber-mounted crane.' Ore and waste are broken by drilling and blasting 9-in. diam vertical holes behind the benches. Bucyrus-Erie 42-T churn drills are used to drill the holes, which are extended 4 ft below the bench level on which the broken rock will fall. Drilling and Blasting History: In its early years the mine was equipped with Bucyrus-Erie 29-T churn drills, which drilled 6-in. holes. To keep up with production requirements the hole diameter was soon increased to 9 in., and by 1950 the three 42-T drills now in use had been acquired. Early blasting experiments with different kinds and grades of explosive led to adoption of 90 pct straight gelatin dynamite as standard. It was recognized that this explosive was expensive, and from the start of operations until 1950 extensive experiments were made using blasting agents of the ammonium nitrate family. Results were recorded as uniformly poor, with great build-up of oversize rock. The expense of these experiments, and the discouraging results, caused the abandonment of any expectation of breaking MacIntyre rock with anything but 90 pct straight gelatin dynamite. Further standardization led to 9-in. well drillhole spacings set at 16 ft in ore and 18 ft in waste, exceptions being permitted only for unusual conditions. The hole burdens were theoretically about 22 ft. Due to the extreme back-slope of bench faces, caused by blasting with heavy charges of dynamite, actual burdens were commonly well over 30 ft. Lack of precise control resulted in many holes having a burden as light as 15 ft. General practice was to stem 6 or 7 ft of hole with magnetite concentrate, the amount of stemming being left to the discretion of the pit foreman. In this investigation, polyethylene terephthalate (Mylar) was coated with various thicknesses of a vapor-deposited silvel- precoat followed by a uapor-deposited zinc using several orders of- magnitude variation in deposition rate of both the silver and zinc. The grain size and resistivity of the zinc film was primarily a function of the silver precoat thickness (in the range of 0.001 to 10 average Agprecoat thickness) and a secondary function of the zinc film thick-ness. The silver and zinc deposition rates were found to have a minor effect on the characteristics of- the zinc film. Electron and X-ray dilffraction results slwwed that all zinc films exhibited a fiber texture mith the (0001) axes essentially perpendiculav to the platze of the film When coating nonmetallic substrates such as paper or plastics with zinc metal vapors, it is found that the zinc will not condense unless extremely high evaporation rates or very low substrate temperatures are used. In 1931, Fraser' reported a procedure whereby zinc could be made to condense on nonmetallic substrates by depositing a very thin precoat of silver. Utilizing Fraser's method, the ermans' developed a commercial process of making "metallized film" capacitors during World War 11. The metallizing process, which was introduced in the United States shortly after the conclusion of World War 11, became one of the first large-scale commercial applications of vapor-deposited metal films and remains one of the larger applications in the electronics industry. The process, as developed by the Germans, consisted of depositing a thin precoat of silver on lacquered, kraft paper followed by a conducting layer of zinc. The resulting silver-zinc film was used as the capacitor The term silver-zinc will be used throughout thiz paper to mean a metal film formed by an extremely thi layer of silver, 10A or less in average thickness, and a zinc film IOOA or more in thickness deposited on the silver film. ---. electrode with the lacquered paper being the dielectric. When polyethylene terephthalate was marketed by E. I. Du Pont Co. in the early 1950's under the trade name Mylar it was substituted for the kraft paper in many capacitor applications. Even though manufacture of metallized paper and metallized Mylar capacitors has been a large commercial process for many years, little information has been published about the deposition parameters. THE lead district of Southeast Missouri covers an area of over 3000 square miles, including Maries County on the west, Jefferson on the east, Franklin on the north, and part of Madison on the south, or parts of ten counties. A general section of the rocks of the southeast part of this region would be about as follows, numbering from the top 1. Sandstone (the second of Missouri geologists), - 20 feet. 2. Cbert beds-beds of passage below, - 125 feet 3. Magnesian limestone, chert, and quartzite, - 100 to 300 feet 4. Lower magnesian limestone, - 100 to 150 feet 5. Gritstone and lingula beds, - 50 feet 6. Ozark marble beds, - 5 to 20 feet 7. Sandstone and conglomerate, - 5 to 90 feet 8. Porphyry, Archaean. 9. Granite, The thickness is approximate, for it is not possible to obtain the correct thickness of the various beds. No. 1 may be seen as de¬tached outliers or loose masses of a hard sandstone or quartzite, and is found on the hilltops in the southern part of Madison County, in like topographical position in Reynolds County and the western part of Washington County. No. 2 consists of alternations of chert, clay, and quartzite. It is the formation which contains most of the limonite deposits of Central and Southern Missouri. In Reynolds County shafts have pene¬trated it 75 feet. Outcrops there and in Madison would indicate it to be at least 125 feet thick. Fossils obtained in various places prove it clearly to be of the age of the calciferous sandrock of the New York system, and Nos. 1 and 2 may also be referred to the age of the second sandstone of Missouri. No. 3 consists chiefly of thick beds of ash, drab and flesh-colored magnesian limestone, both coarse and fine-grained. These beds, where they occur, in Washington, Jefferson, and the southern part of Madison Counties, contain a good deal of quartz in drusy cavities. In Washington County the limestones are beautifully ramified by a system of connected drusy cavities generally lined with minute quartz crystals arranged in botryoidal and mammillary forms, and called u mineral blossom " by the miners. This is the lead-bearing rock of Washington County, but in the southern part of Madison it does not appear to be galeniferous. It is also undoubtedly the equivalent of

INTRODUCTION This paper discusses the design of the subsurface nuclear waste repository at Yucca Mountain, Nevada; and possible concepts for construction of the subsurface facility. Subsurface construction at Yucca Mountain is planned to last for 20 or more years, and may be accomplished using tunnel boring machines (TBM), drill and blast methods, raise bore machines, and roadheaders. The design of the subsurface facility includes approximately 107 km (66 miles) of tunnels and drifts. The vast majority of the repository will be excavated with TBMs. Design and construction concepts for the subsurface repository discussed in this paper are based on the License Application that was submitted to the U.S. Nuclear Regulatory Commission (NRC) by the U.S. Department of Energy (DOE) on June 3, 2008. The License Application was subsequently docketed by the NRC in September 2008. When a Construction Authorization is received from the NRC, notices to proceed with subsurface construction at Yucca Mountain will be issued by DOE. The Yucca Mountain site is located in the Mojave Desert approximately 150 km (90 miles) northwest of Las Vegas, Nevada. The site is on federal land in southern Nevada and is shown in Figure 1. Yucca Mountain is a ridge of volcanic rocks com-posed primarily of solidified volcanic ash. Previous underground construction work at Yucca Mountain included excavation of two tunnels using two different TBMs. The first tunnel, the Exploratory Studies Facility (ESF), is a 7.62 m (25 ft) diameter tunnel that is 7,877 m (25,843 ft) long and was described by Morris and Hansmire at the Rapid Excavation and Tunneling Conference (RETC) in 1995. The second tunnel, known as the Enhanced Characterization of the Repository Block (ECRB), was a TBM drive of 5.0 m (16 ft, 5 in.) in diameter and 2,681 m (8,796 ft) long. The second tunnel was excavated in 1998 and was described by Fulcher, Eastlund and Copeland at RETC 1999 and is named the East?West Cross Drift in that paper. (These previously excavated tunnels are shown in Figure 2.) In the volcanic rock formation where the vast majority of the planned repository will be con-structed, previous tunneling conditions were generally very good.

Conventional processes for disintegration of ores are characterised by low selectivity and cause damage to the components of their structure. It affects their liberation and recovery which are connected also with the inevitable formation of extreme fines. In the world practice recently came into view 4 trend to grinding of materials within a thick layer (in a bed layer), which provides a substantial selectivity of liberation, for example, of kimberlite. The degree of diamond preservation in the final product is highly increased. However, this method causes a considerable overgrinding of material. A new method of intralayer vibro-impulse breaking of materials providing an easily adjusted force acting at the layer and timely removal of product size grains from the grinding chamber has been developed in Russia.

Soon after general use of stainless steels began, it was observed in practice that certain combinations of factors tended to induce corrosion by pitting. For most applications this was a serious drawback, not so much because the structural properties of the metal were impaired but because of the rapidity with which heavy sections of the alloys were penetrated by small elongated pits. These pits seemed to initiate readily in oxidizing metal salt solutions like ferric chloride and in chloride solu-tions like sea water. It was observed that in sea water pitting was more frequent in stagnant or polluted waters than in highly aerated, moving waters. The steels in these chloride solutions were observed to be sensi-tive to long contact with material such as sand grains or attached bar-nacles. At points of attachment or contact it was not uncommon to discover initiation of corrosion. Pits once begun at contact faces were observed to grow rapidly, usually elongating phenomenally in the direc-tion of gravity until the metal was perforated. Hydrochloric acid and other nonoxidizing acids, on the other hand, were observed to corrode stainless steels generally; the weight losses often were higher, but the penetration less than for the pitting type of corrosion. The causes of pitting, a type of corrosion recognized as character-istic not only of stainless steels but of many additional metals and alloys, are important in corrosion studies. A possible explanation bears prac-tical significance, for once it is known why pits begin where they do and continue to grow after initiation, intelligent direction can be given to diminishing corrosion. This can be done either by some alteration in the composition and treatment of the alloy or by some alteration in the environment. It appears foremost in importance to discover the nature of pit foci, for if initiation of pits can be discouraged their growth will be no longer a factor to be considered. THE behavior of molybdenum and its surface oxides in oxidizing and reducing gas atmospheres and in high vacua at elevated temperatures is a question of scientific and technical importance The use of molybdenum as a metal or as an important component in alloys in oxidizing atmospheres at elevated temperatures has been limited because of the unprotective nature of its oxide film and the volatility of this oxide at moderate temperatures. This communication will present results of a vacuum microbalance study 1,2 of the following problems. (11) the oxidation kinetics in the temperature range of 250° to 450°C; (2) the reduction with pure hydrogen of thin oxide films formed on molybdenum; (3) the volatility of the thin oxide films, and (4) the vacuum oxidation of molybdenum at high temperatures. Molybdenum is an interesting metal to study for the following reasons: (I) although the oxide-to-metal-volume ratio is greater than one, the metal is not considered protective; (2) the metal oxidizes readily at temperatures of 250°C and higher; (3) the oxides of the metal are reduced at temperatures as low as 500°C by pure hydrogen; (4) the oxide MoO3 melts at 795°C; and (5) the oxides of molybdenum are volatile at moderate temperatures. The following variables are studied in the oxidation kinetics. time, temperature, pressure, surface preparation, surface area, concentration of inert gas in the lattice, cycling procedures in temperature, vacuum effect and high temperature vacuum oxidation The general interpretation of many of these factors has been previously discussed. LITERATURE The oxidation of molybdenum has not been studied critically. Although" many studies have probably been made on the kinetics of the oxidation process, none has been reported in the literature available to us. The crystal structures found in the oxidation of molybdenum have been studied by Hickman and Culbransen 4 Their results showed that MoO2 is the oxide which is stable in contact with the metallic subgtrate throughout the temperature range 300 to 700°C. As the film thickens in the low temperature range, MoO3 becomes predominant on the surface. Above 400°C, Mo03 is no longer observed, Mo02 being the only oxide found. Hagg and Magneli5 have shown from an X ray study that the a-phase, orthorhombic MoO3 is stable up to 1050°C. Two other phases, ß and ß', with compositions close to Mo02 90 are also obtained The formula for the ß phase is not given but that of the ß' phase is defined as Mo9026. The ß' phase is found to be built upon a monoclinic unit cell. A -?-phase is isolated from a preparation M00275 heated for 17 hrs at 670°C. This phase is

The Mines Operating Co.'s plant at Park City, Utah, was designed to treat the low-grade fillings in the old stopes of the Ontario mine. These fillings carry 6 to 14 oz. of silver, 1 to 2 lb. of copper, 0.01 to 0.015 oz. of gold, and a small percentage of lead and zinc. The treatment consists in mixing the crushed ore with coal dust and salt and then roasting in a new type of furnace by combustion of the contained fuel. The roasted ore is leached with an acid salt solution to dissolve the silver, gold, copper, and lead. At present these metals are precipitated together on scrap iron and the product sold to a refinery. The only new feature of importance in this scheme of treatment is the roasting process, which makes possible the chloridizing of ores without any loss of the valuable metals, and at a very low cost. History of the Development of the Process The roasting process- had its beginning in connection with research work at the Utah State School of Mines. N. C. Christensen, Jr., who held one of the School of Mines' fellowships, was engaged in some experimental work on blast roasting. At the same time I was doing some work on the insoluble gold in Mercur base ores. Mr. Christensen roasted some of this base gold ore in his pot furnace, and found that when he mixed a sufficiently low percentage of fuel with the ore, it did not sinter but roasted to a leachable product. We considered this a new application of blast roasting, and proceeded to test out a large number of ores in several different types of small roasters which we constructed.. This experimental work continued well into the summer of 1911. In August, 1911, the Consolidated Mercur Gold Mines Co. installed a small roaster of our design, which we proposed to operate on the counter-current principle, feeding mixed ore continuously on top, and at the same time drawing off the roasted ore from the bottom. By proper adjustment we hoped to maintain a permanent roasting zone near the center of the column, the ore moving downward as roasted. However, we

In the early ages man contented himself with the use of such tools and appliances as would assist him in the enlightenment of his labours. With the advancement of science, numerous motives, with modifications and adaptations, have been introduced to enlighten labours, and in many cases have taken the place of man, but it can hardly be said that this applies to shovels, although one of the oldest implements of labour; certainly, with the introduction of the steam shovel the labours of man have been considerably reduced, but the hand shovel of today is used similarly to that of years ago.If the principle of the hand shovel has not been improved upon, it must not be suggested that the manufacturers of this article are not endeavouring to improve its quality, and the main point with which the manufacturers have to contend is the production of an article which will give a maximum of durability combined with a minimum of lightness. In order to accomplish this they must select suitable material, and subject it to such heat treatment process that will produce a shovel having a maximum of hardness and toughness without being unduly brittle, and which will withstand the excessive wear to which it is subjected.In this article an endeavour will be made to explain (a) the manufacture of shovels; (b) the defects commonly met with-the cause of same and measures which are necessary to remedy them.Before doing so a brief description will be given of the class of steel used for shovels; this is an important factor, and a steel which is admirably suitable is a plain carbon one containing approximately 55 - 70% C., and closely resembles that used for the manufacture of railway rails. This plain carbon steel is very extensively used, although at present alloy steels are being utilised to a certain extent for shovel manufacture, and with suitable heat-treatment.

The two calcium sulfate minerals, gypsum and anhydrite, occur in many parts of the world, and gypsum has long been of economic importance in the family of industrial minerals. Gypsum, the dihydrate form of calcium sulfate (CaSO, . 2H20) and anhydrite, the anhydrous form (CaSO,) are frequently found in close association, and it is seldom that a calcium sulfate deposit will consist exclusively of one mineral or the other. Although known gypsum deposits are extensive, anhydrite makes up the larger part of total calcium sulfate resources. Although it has very minor economic use, it is important to the understanding of gypsum deposits and is referred to frequently in the following discussion. Calcium sulfate is one of the principal constituents of evaporite deposits, and when pure, has the following composition: [ ] Deposits of pure gypsum or of pure anhydrite which are large enough to be considered commercial have not yet been found because of both the metastable relationship between the two minerals, and the presence of impurities such as calcium or magnesium carbonates, chlorides, other sulfate minerals, clay minerals, or silica. Most gypsum produced ranges from 80 to 95% pure and beneficiation is normally limited to selective mining or quarrying or upgrading by crushing and screening during mill processing. END USES The largest use for gypsum is based upon the unique property which calcium sulfate has of readily giving up, or taking on, water of crystallization. With the application of a moderate amount of heat in a process known as calcining, gypsum is converted to plaster of paris, the hemihydrate of calcium sulfate (CaSO4 ½ H2O), which when mixed with water will set or harden as the calcium sulfate returns to the stable dihydrate form. This semifinished product, usually called stucco, is then manufactured into a large variety of plasters, wallboard, and block for construction use, or into plasters for industrial applications. About 75% of the gypsum used in the United States is calcined for these purposes. Uses of uncalcined gypsum are principally as a retarder for portland cement, as a soil conditioner, as a mineral filler, and other minor industrial applications. About 25% of the gypsum mined in the United States goes into these markets; however, in other countries with building practices different from those in the United States and Canada, relative usage varies widely. Calcium sulfate deposits are the world's largest sulfur resources; minor quantities of gypsum and anhydrite have been used to produce sulfur or sulfur compounds. This use is accompanied by a unique site-specific set of economics because sulfur is generally available from non-gypsum sources at lower cost.

The recent and rapid development of the physics of engineering materials at temperatures as low as that of liquid air and as high as that of the electric are, has drawn renewed attention to the absence of tables, properly printed and spaced, for the convenient and accurate translation of temperature from centigrade to Fahrenheit scales and vice versa. It is to be noted that the Fahrenheit scale is the almost universal usage in foundries and shops in the United States, though the laboratories of the same works employ the centigrade notation. The growing use of the electric furnace in Germany and France calls for much American citation all in centigrade high temperatures, and while the arithmetical calculation is simple, it becomes burdensome when often repeated. I have been surprised at the numerous reprints of Table I. from centigrade to Fahrenheit degrees, first privately printed for personal use, which have been made by works, blue-prints, text-books, and technical journals, and I hope that Table II., from Fahrenheit to centigrade degrees, will be equally useful. For mental calculation the easiest rule to convert centigrade into Fahrenheit is to add 32° to twice the centigrade reading less one-tenth of this product: Thus 1000' C. = 2000" — 200" + 32" = 1832" F., and to convert Fahrenheit to centigrade, subtract 32" from the Fahrenheit reading, multiply by 10 and divide by 2 and 9 successively : Thus 1000° F. = 1000° — 32° = 968° X 10 = 9680° - 2 = 4840° - 9 = 537.77° C. "This paper looks at what has happened in the past decade in the rare earth industry, particularly for those companies outside China trying to develop alternative projects to the Chinese dominated supply chain. The rare earth industry has gone through a metamorphosis over the past decade. The industry was basically unknown outside China until overnight it became the next hot topic on the financial streets of Canada and Australia. Suddenly various junior miners shifted from uranium and other out-of-favor commodities to rare earths as funds were easy to access from an investment community that did not understand the complexities of the space. The initial funding was done on traditional junior mining metrics of grade and deposit size. This has morphed over time to:1) Lights versus heavies2) Making a concentrate3) The importance of separation4) Off-take agreementsAt the peak of the market frenzy certain flagship operations were built using the “Not Made in China” moniker. Unfortunately certain errors were made during implementation, which are finally coming to the surface and making the rest of the pack wondering what will happen next. A review and update of some of the mistakes made and lessons learned will be discussed.BACKGROUNDAbout ten years ago awareness started to form around the rare earth industry and various groups recognized that because of the closure of Molycorp, Mountain Pass, and the dominance of China, there was a risk of uncertainty of reliable supply. This was not news for those active in the industry like Rhodia (now Solvay), the Japanese, South Koreans and other key consumers but to others it was like a light went on and rare earths became the new “.com” trend for investment banks, investors and some mining companies looking for the next hot topic.In the late 1990’s Molycorp accounted for around 20-25% of the world’s supply of rare earths, mostly lights (La, Ce, Pr and Nd), with small amounts of heavies from other sources. Then environmental issues forced the closure of the operation at Mountain Pass. Within six months China had increased production to plug the gap in supply. Around that time China was developing a strategy to leverage their position in rare earths and implemented a series of regulations to increase the value added component of rare earths inside China."

INTRODUCTION * The United States is fortunate in having enormous reserves of metallurgical-grade coals. Although these coals are better in quality and more accessible than most coals found throughout the rest of the world, the best grades of these coals are being depleted. Consequently, more efficient exploration tools and techniques, such as advanced methods of core drilling and logging, correlation by palynology,** stratigraphy, paleontology and petrography are being used to help assess the extent and quality of the remaining coal reserves. Exploration and assessment of new and existing coal properties become of utmost importance in determining (1) the economic justification for mining the coal, (2) the optimum design of the preparation plant and (3) the most effective use of the coal. Fortunately, the cost of mining coal has remained stable because of better mine planning, more efficient operations and increased mechanization of mining operations. However, increased mechanization raises the amount of impurities in the coal mined, and this requires more and better coal beneficiation to meet the more stringent quality requirements set by the market. Besides, mechanical miners also produce relatively fine coal and, to ensure maximum liberation of impurities, much of the coal presently being used must be crushed to a finer size prior to preparation. The bulk of all coals presently used in this country is mechanically cleaned, much of it at a lower specific gravity than in the past. This necessitates the use of new and improved processes and equipment for coal washing and recovery, such as heavy-medium cyclones and vessels, and froth flotation cells. However, because wet-cleaning processes are pre- dominant in the United States and fine coal retains large amounts of moisture, the increased production of cleaned fine coal accentuates the need for new or improved methods and equipment for dewatering and drying this coal. The larger amounts of coal being beneficiated and the use of new and improved beneficiation processes will aid in controlling and ultimately eliminating sources of pollution. Modem coal markets demand coals that meet rigid specifications. Most coals are purchased under contracts that specify moisture, ash, and sulfur contents, or heating value, depending upon the end use. There has also been a growing trend toward specifying other properties, including particle size and coking capability. INTRODUCTION "Most people would probably agree that some degree of government control and regulation is essential in modern society, and it will likely continue as an important part of our social organization for the foreseeable future. But most of us tend to be ambivalent about it. In one situation or another we are likely to see government commitment to social benefit programs or regulatory devices either as an expanding encroachment on the freedom of the individual or as an undue interference with private enterprise or with the rules of the market place. But even where there is agreement as to the desirability of government initiatives, either in general or in a particular context, it by no means follows that there will be approval of the mechanisms or procedures used or the means of carrying them out." The above statement is taken from a 1980 Working Paper of the Law Reform Commission of Canada prepared in connection with its study of the exercise of administrative law in Canada and the practices and procedures of administrative tribunals. The Atomic Energy Control Board (AECB) is one such administrative tribunal, and as the federal nuclear regulatory authority, it is responsible for licensing the production, possession and use of nuclear materials, equipment and facilities and enforcing compliance with licence conditions governing the health, safety, security and environmental aspects of the activities involved. Although the AECB was established 35 years ago with the passage in August 1946 of the Atomic Energy Control Act, like many administrative tribunals its role and functions and the regulatory process which it applies have evolved significantly during this period. The changes which have taken place over the years reflect not only the vast scientific and technological developments which have occurred but also the marked differences between contemporary society and the social milieu of the mid-1940s. However, the basic philosophy of nuclear regulation in Canada and the underlying principles of the regulatory process have changed very little. Certainly, the process is far more open in terms of the general public, it has become appreciably more comprehensive and systematic in terms of the depth and extent of both the pre- and post-licensing technical evaluations which are conducted and the ensuing compliance program. Furthermore, it now applies to the whole of the nuclear fuel cycle as well as the industrial, agricultural and medical applications of radionuclides. Nevertheless the following fundamental principles remain unchanged: a. primary responsibility for achieving high standards of nuclear safety and environmental protection in the design, construction, commissioning and operation of nuclear facilities resides with the licensee; b. the credibility of the nuclear regulatory process depends not only upon its technical correctness and practicability, but also upon acceptance by the public-at-large of its perceived effectiveness and efficiency; c. regulatory criteria and principles should be concise, clearly stated and understandable; d. regulatory decision-making should be based upon stated criteria and principles taking into account pertinent scientific and technical facts only; e. fairness and impartiality must characterize all regulatory decision-making; f. the regulatory process should be subject to a comprehensive periodic review and evaluation to ensure that it continues to produce the desired results at justified costs. EXPLANATORY NOTES The mere statement of a set of principles is a relatively simple task. Far more difficult is the explanation of what these principles mean in practical terms. To stipulate that a licensee bears the primary responsibility for achieving and maintaining high standards of nuclear safety and environmental protection may be regarded by some as an attempt by the regulatory agency to evade the responsibilities assigned to it. However, this is not the case. It is unrealistic for anyone to claim that a licensee only complies with accepted norms of public and occupational health and safety and of environmental protection because of the fear of prosecution.
